No! Some agents are strictly listing agents, some are strictly buyer's agents and some do both. That's the whole point of having different agency relationships. Many many years ago there were only listing agents. If you wanted to buy a house, you contacted the listing agent of each house you wanted to see. (this was called "Dual Agency"). Listing agent basically worked with seller and buyer but really didn't have any loyalty to the buyer. This was extremely unethical since the listing agent was working for the seller, not the buyer. Now we have buyer's agents who represent the buyer and take them to view listings of other agents. If the house fits the buyer's criteria, why would I NOT show it to them? It would be UNETHICAL for me not to!

If you're selling and you're concerned about listing with an agent who only lists homes, you shouldn't worry. Your home is being seen my thousands of other agents and their buyers. If you're not getting showings, then there's some other factor involved. Showing condition? Photos? Price?

Not required with a sales flyer...but when you draw up a contract, your agent should provide with the purchase contract to be signed by the buyer before going into attorney review.

I believe you should answer all questions on your sellers disclosure as fully and honestly as you can. It is better to be up front about the area than lose a buyer after getting an offer because they drove by after a rainy day and discovered it themselves. ... more

It is frustrating however when an out of county appraiser....several counties away matter of fact, compares your home to a comp that is miles away...I have had that scenario as well. This is not a complicated question like other agents make it out to be. You asked a simple question and you want a simple answer, right?

Commissions are determined when the Listing Agent gets the listing. Depending on the price of the home, the usual starting point for commission is 6%. That gets split between the Sellers Agent and the Buyers Agent (3% each). However, sometimes at the time of listing the home, the seller will negotiate the commission with the agent.

All listings are different but usually stay around the 5-6% range.

Francesca is right - the "pool" situation has changed the landscape signficantly. I had a similar situation where an out of area appraiser really botched the appraisal and it came in 10% below the sale price. All parties agreed it was way off - even the buyer. We joined forces and succeeded in getting a second appraisal and the deal stayed on track. But this goes back nearly 2 years now and the appraisal situation has become much more rigid in my estimation since then. I believe the "pool" was at its early stage when I ran into trouble.

There is no reason not to try - if you comps/analysis is sound, try to push back and see where it takes you. Get the support of your agent.
