You only need a real estate license if you are handling property either for sale or lease FOR OTHERS. The licensing law, which can be found here:, gives the following as exceptions to the requirement for a real estate license. To be sure, you might want to call the real estate commission and identify section 93A-2.

(1) Any person, partnership, corporation, limited liability company, association, or other business entity
who, as owner or lessor, shall perform any of the acts
aforesaid with reference to property owned or leased
by them, where the acts are performed in the regular
course of or as incident to the management of that
property and the investment therein. The exemption
from licensure under this subsection shall extend to
officers and employees of an exempt corporation,
the general partners of an exempt partnership, and
the managers of an exempt limited liability company when said persons are engaged in acts or services
for which the corporation, partnership, or limited liability company would be exempt hereunder.
(2) Any person acting as an attorney-in-fact under a duly
executed power of attorney from the owner authorizing the final consummation of performance of
any contract for the sale, lease or exchange of real

This home would NOT qualify for USDA as it is in the city limits of Hickory, NC. The pool may be an issue as well for qualifying for USDA. This home is currently pending/under contract.

I just checked the MLS and this property has a contract on it to purchase and it has been marked PENDING. It has a June 12, 2009 closing date. However, if the buyers cannot get lending it may be back on market soon. It is a foreclosure and has special guidelines buyers must follow. "As-Is, Where-Is" is the greatest one. Most lenders have already lost money on these and don't want to spend any more on it. Cash offers get more attention as there are no lending issues.
