The use of a real estate attorney is not mandatory. With that said, depending on how your contract is written, you may want to have the additional protection of getting a real estate attorney involved given that there are often times events that occur where you will want that representation. Although a real estate attorney can do the closing here, or a title company may have an attorney in their offices, they will merely address issues to the transaction as a whole, and not separately represent you. If you feel that you want the added protection and peace of mind, then it would be well worth the fee you would pay which can range somewhere between $500-$1000, as a flat fee. Good luck with your home sale.

Oakland Park outsourced their police department to the Broward Sherrif's Office and the supplied URL will take you right to the City Of Oakland Park's web site and page that contains current and historical maps of where the crimes in the city occurred and the type of crime committed. The City may publish the maps on their site but BSO develops them from their compliled data for a specific time frame As for the area I'm in, I have no problem going out at night for a walk but your comfort in an area is never a reason to let your guard down because no place is immune from crime.

Additionally, when you use a real estate professional, we can advice you immediately if the foreclosure procedure has been initiated by the bank. However, without access to the owners credit report we would not be able to state definitively if the property is in jeopardy.

You can also determine how many condos have been sold in a particular building, what they sold for, and for how much. Also; a huge factor is to know how long the units took to sell.

Researching the history of the building and checking various statistics before you put your home on the market can help you make informed decisions in regard to pricing, and although no one has a "crystal ball" to say how fast a unit will sell; verifying the above factors can give you a fair idea of what to expect.

When a property is listed by a Real Estate Agent they are professionals and by law they should be complying with your state and local laws and procedures. Part of the process to get to final contract is that the house needs not only to be checked through and have clear title, but it is also wise to have property inspections, an appraisal and other items that may come up. As an Agent, it is their “importance” that everything will run smoothly for all involved. This could eliminate much of the things that you would have to accomplish on your own if you are purchasing a FSBO.

Also, an Agent also helps when negotiating is involved. They can take your offer back and forth with the Seller and try to reason a good price for all. Now do note, that when you are buying, you can hire a Buyers Agent to assist you and negotiate for you.

Now, purchasing through a FSBO directly, just make sure that when you have found the home that you are interested in and have come to an arrangement with a purchase price, hire a good Real Estate Attorney to guide you and make sure that everything is as it should.

Foreclosures are a little different. Depending on the progress of the Foreclosure (if they are in pre-foreclosure or already bank owned) the steps are a little different that in the other cases. Plus each bank or lender has their own process that they require to be followed. At this moment, you can find very nice properties and investments. However, I recommend that first you find an Agent in your area that is specialized in Foreclosures and Short Sales and have them walk you through a “foreclosure process” in your state so that you may see the difference.

For unmotivated sellers, is it a line in the sand, often based on their interpretation of the media reports, what their neighbor 'said' that his/her home sold for, and more of a fishing effort. You will be able to quickly identify these sellers by their approach to negotiation.

When working with buyers, I always prepare a market absorption analysis for the past 6 months, and review the current inventory and those sold, when determining an offer. This approach is invaluable when positioning a lower offer to the seller, as the market absorption analysis facts introduce reality, allowing the seller to quickly grasp the situation.

Sell now, or try to be the one in X to sell next month.
