TENANT LIABILITY FOR DAMAGES AND REPAIRS
In strict accordance with California law, standard maintenance, repairs, and structural system preservation resulting from ordinary wear and tear shall be the sole financial responsibility of the Landlord at zero cost to the Tenant. Conversely, Tenant shall be 100% financially responsible for the full cost of all repairs, maintenance, replacements, and service calls necessitated by the misuse, neglect, abuse, improper operation, or intentional actions of Tenant, occupants, guests, invitees, or unauthorized occupants. Except in urgent emergencies, Tenant must obtain Landlord's prior written approval before arranging, contracting, or initiating any physical repairs or alterations to the Property.
WATER DAMAGE PREVENTION
Tenant shall exercise due care to prevent water damage and shall immediately notify Landlord of any plumbing leaks, roof leaks, appliance leaks, structural water intrusion, abnormal moisture conditions, drain backups, or overflowing fixtures. Tenant shall be held fully liable for all structural, dry-rot, mold, and secondary damages resulting from delayed reporting or failure to exercise reasonable care.
PROMPT MAINTENANCE REPORTING
Tenant shall promptly report to Landlord in writing any malfunction, defect, or damage to major building systems, including HVAC heating/cooling systems, plumbing infrastructure, electrical grids, structural roofs/walls, pest activity, visible mold concerns, appliance failures, or security/safety hazards. Failure to provide immediate written notice may result in Tenant financial responsibility for any compounding or secondary damages to the Property.
CLEANLINESS STANDARDS AT MOVE-OUT
Prior to surrendering possession, Tenant shall return the entire Property, including floors, bathrooms, kitchen, major appliances, cabinets, and interior windows, in the exact same condition of cleanliness as received upon move-in, ordinary wear and tear excepted. If the Property is not returned to this baseline standard of cleanliness, Landlord may deduct the actual, documented, and reasonable costs of professional cleaning services from Tenant's security deposit in accordance with California Civil Code Section 1950.5.
ABSOLUTE PROHIBITION ON SHORT-TERM RENTALS & SUBLEASING
Tenant shall not advertise, list, license, rent, sublease, or permit temporary occupancy of any portion of the Property through Airbnb, VRBO, Booking, Furnished Finder, or any similar peer-to-peer short-term hospitality platforms without the explicit, prior written consent of the Landlord. Any unauthorized listing or short-term rental activity constitutes an incurable material breach of the Lease and grounds for immediate eviction under California law.
ABANDONED PERSONAL PROPERTY
Any personal property, electronics, furniture, or belongings left behind by Tenant on the Property after the official surrender or abandonment of possession shall be handled strictly in accordance with
California Civil Code Sections 1980 through 1991. Tenant shall remain fully responsible for all lawful storage, legal notices, removal, public auction, and disposal costs incurred by Landlord.
15. APPLIANCE CONDITION AND INSPECTION PROCEDURES
Tenant shall fully inspect all major appliances supplied by Landlord within five (5) calendar days of move-in and notify Landlord in writing of any mechanical or cosmetic malfunctions. Failure to provide written notice within this window shall constitute a binding acknowledgment that all appliances were received in perfect working order, ordinary latent defects excepted. Tenant shall promptly report appliance failures and shall be financially responsible for repairs stemming from improper operation, overload, neglect, or unauthorized modifications.
16. RE-KEYING AND LOCK CHANGES
Tenant shall not change, replace, add, re-key, alter, or modify any locks, deadbolts, electronic keypads, or access codes on the Property without the prior express written consent of Landlord. Any approved lock modifications must be performed by a licensed professional locksmith vetted or selected by Landlord. Tenant must provide Landlord with copies of all new physical keys and access codes immediately upon completion of the work.
17. UTILITY TRANSFER REQUIREMENT
Tenant shall legally transfer all utilities designated as Tenant's responsibility into Tenant's name within five (5) business days after the official commencement of the tenancy. Tenant shall maintain uninterrupted utility service throughout the entire tenancy. Allowing utilities to be shut off or disconnected due to non-payment constitutes a material lease default and a threat to property safety.
18. NEIGHBORHOOD QUIET HOURS
Tenant, occupants, and guests shall refrain from creating excessive noise, loud music, or vibrations that interfere with the quiet enjoyment of neighboring residents. Strict quiet hours shall be observed between 9:00 PM and 7:00 AM daily. Televisions, audio speakers, musical instruments, and other sound-producing devices must be kept at a volume that is not audible outside the boundaries of the Property during these hours.
19. PAINT TOUCH-UP AND WALL DAMAGE
Tenant shall return all painted interior walls and structural surfaces in substantially the same condition as received, ordinary wear and tear excepted. Tenant shall be financially responsible for the specialized repair and repainting costs of damages caused by: excessive or oversized nail holes, heavy anchors, wall mounts, television mounting brackets, adhesive strips/stickers, unauthorized custom painting, or writing instruments. Deductions from the security deposit for wall repainting shall be assessed in accordance with California law and standard useful life depreciation guidelines.
20. EARLY LEASE TERMINATION POLICIES
If Tenant requests to vacate and terminate the Lease prior to the natural expiration of the Lease Term, Tenant must deliver a minimum of thirty (30) days' prior written notice to Landlord. In accordance with California Civil Code Section 1951.2, Landlord will make reasonable, good-faith efforts to re-rent the property to mitigate damages. Tenant remains legally and financially liable for: (a) Monthly rent and utility charges accruing until a qualified replacement tenant commences paying rent or the original lease term expires; (b) Any monthly rent differential if Landlord is forced by market conditions to re-rent the property at a lower rate; and (c) All reasonable advertising, tenant screening, and administrative expenses directly incurred to secure a replacement tenant.
