1. TERM OF LEASE
The lease shall be for a fixed term of 1-2 years (1-2), beginning on April 1, 2026 and ending on March 31, 2027 or March 31, 2028 ("Lease Term"). Tenant shall surrender possession upon expiration unless renewed in writing.
2. RENT
Tenant agrees to pay rent in the amount of $1,700.00 per month.
Due Date: Rent is due on the 1st day of each month
Accepted Payment Methods: Venmo, Zelle, check, or other electronic payment method approved by Landlord
Delivery: Payment must be received (not sent) by the due date
Failure of a payment platform does not excuse late payment.
3. LATE PAYMENTS, GRACE PERIOD, AND FEES
In accordance with Colorado law:
A 7-day grace period applies. Rent is late if not received by 11:59 PM on the 7th day.
Late Fee: $85.00 (5% of monthly rent, compliant with statutory limits). Late fees shall not be compounded or assessed prior to expiration of the grace period
4. SECURITY DEPOSIT
Security Deposit Amount: $1,700. The deposit secures performance of all Tenant obligations, including damages, unpaid rent, cleaning, and lease violations. Return of Deposit:
Returned within 30 days after lease termination
May extend up to 60 days if necessary. An itemized written statement of deductions will be provided. Failure to provide such statement may subject Landlord to statutory penalties under Colorado law
5. UTILITIES
Tenant Responsibility: Electricity, gas, water, sewer, trash, internet, and all other utilities/services. Tenant shall place utilities in their name prior to move-in.
6. MAINTENANCE AND REPAIRS (WARRANTY OF HABITABILITY): Landlord shall comply with Colorado's Warranty of Habitability requirements.
Landlord Responsibilities: Maintain premises fit for human habitation. Repair major systems: plumbing, heating, electrical, structural components, and provided appliances
Tenant Responsibilities: Maintain cleanliness and sanitation. Use fixtures/appliances properly.
Replace minor items (light bulbs, filters, batteries)
Promptly notify Landlord of defects. Failure to report issues may result in Tenant liability for resulting damages.
7. LANDLORD RIGHT OF ENTRY
Non-Emergency: Minimum 24 hours' notice.
Notice shall include date, time window, and purpose. Emergency Entry: Permitted without notice. Entry allowed for repairs, inspections, maintenance, or showing to prospective tenants/buyers. Unreasonable refusal of access constitutes a lease violation.
8. PROPERTY CARE (EXTERIOR MAINTENANCE)
Tenant is responsible for: Snow Removal: Prompt clearing of walkways/driveways. Garbage: Proper disposal and compliance with local regulations
Lawn Care: Mowing, watering, and general upkeep. Failure to maintain may result in Landlord performing services and billing Tenant.
9. SUBLETTING AND ASSIGNMENT
Tenant shall not sublet or assign this Agreement without prior written consent of Landlord.
Consent shall not be unreasonably withheld
Unauthorized subletting constitutes a material breach
10. MOVE-IN / MOVE-OUT INSPECTIONS
A written move-in condition report will be completed. Tenant must note any pre-existing damage. A move-out inspection will determine deductions
11. PET POLICY
Pets are not permitted without prior written approval. If approved: Non-Refundable Pet Fee: $200 per pet (consistent with Colorado market rates) Monthly Pet Rent: $35 per pet
Tenant is fully liable for all pet-related damages, cleaning, and disturbances. Service and assistance animals are not considered pets and are governed by applicable law.
12. SMOKING AND MARIJUANA
Smoking: Strictly prohibited inside the property
Marijuana Cultivation: Prohibited on the premises
Violations may result in cleaning charges and lease enforcement action
13. RENTERS INSURANCE (REQUIRED)
Tenant shall maintain renters insurance throughout the Lease Term: Minimum liability coverage: $100,000. Proof of insurance required prior to move-in and upon renewal.
Tenant acknowledges Landlord's insurance does not cover Tenant's personal property
Failure to maintain insurance is a material lease violation.
14. LEASE RENEWAL / NON-RENEWAL
Tenant must provide written notice of intent to renew or vacate at least 30 days prior to lease expiration.
Lease renewal is subject to Landlord approval and may include updated terms or rent adjustments
Failure to provide notice may result in holdover tenancy or additional charges
15. HOLDOVER TENANCY
If Tenant remains after lease expiration without renewal: Tenancy converts to month-to-month (if accepted). Rent may increase up to 125% of current rent or as allowed by law
16. DEFAULT AND ENFORCEMENT
Failure to comply with this Agreement constitutes default.
Landlord may pursue remedies allowed under Colorado law, including: Notices to cure or quit
Eviction proceedings. Recovery of damages, costs, and attorney fees where permitted
17. ENTIRE AGREEMENT
This document constitutes the entire agreement. Any modifications must be in writing and signed by both parties.
18. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Colorado.
