The owner has defaulted on the mortgage and the property is to be sold at auction. I know I must still pay rent to him until his name is off the deed but can a landlord in default of the mortgage retain rent monies from a tenant in excess of what it cost to maintain the property? That is to say, if the landlord is not paying the mortgage, and he has collected rent, can he pocket any money after normal maintenance costs, i.e., HOAs, repairs, taxes, are paid? I have heard a landlord cannot pocket any rental money past these basic costs if he/ she has defaluted on the mortgage. Same model and other models are selling from $60K to $125 in our NH.  Current median sale price is $100K for previous quarter.  We have seen 5 homes the same as our model foreclose for prices from $60K to $125K and 100's of other homes foreclosed from $75K to $150K. With so many lower priced homes well below $200K in our NH we will never be able to sell our house for anywhere near $350K in our lifetime. This coupled with a significant drop in our investments has us reeling. We want to move to an apartment to lower costs and to be nearer our family in another state. What can we do? If someone would just clean up the front yards of these properties, all of the homeowners would be happier. I figured that if the banks did not have to pay for back yard also, as that is not usually seen from the street or in the neighbors view, it would be a much needed and quick inexpensive neighborhood improvement. Wells Fargo and their attorneys are trying to find a contact at this company to get the deed and all paperwork signed in order for us to close. We are extremely frustrated to be finding out about this just now. Has anyone had an experience similiar to this one? Will everything be resolved in time for closing?
