Let me first start by saying that it is a bank owned home.  We areusing the same bank that is selling the house to finance our purchase of that house.  Therefore, HSBC is selling the house, and we are using HSBC for our loan to buy the house.  We are fully approved for our loan of the purchase price of the house.  The problem comes after we get the appraisal done.  

The appraisal came in at 178K and the house is selling for 190K.  Therefore, the bank HSBC will not lend us more than 178, while they themselves HSBC is selling it for 190K.  

We are trying to negotiate with them to lower the price due to the appraisal, but they are not willing to budge because they say that they dont agree with the appraisal.  The measurement the appraiser gave was 50ft below the county record.  What can we do?  Can the appraiser amend his appraisal and re value the house?

We never wrote  a contract on it and I understand the property is stil on the market.  If I choose to purchase the house using another broker (now being 2 years later) can the first broker claim the commission on the sdale since he intiially showed em the house? I have visited the county tax appraisers website but cannot find it.  Though the site seems to always work for houses, this specific property is a condo and the search is not finding it. Also, two more quick questions. If a property isn't listed as a short sale or an REO, is there anyway to find out if it is specifically either? And lastly, is there anyway I can find out if a home has a lean against it from the home owners association, etc?
