My fiance and I were initially dead set on south/southwest Austin (78745,48,49) but we were not liking what we were seeing in our price range (Under 160k).   Namely, the homes were either too small, or needed a lot of work.  So, we started looking at new home construction, the two year warranty builders like Centex are offering is very attractive to us since I worry about getting into an older home that is going to require a lot of work/money to get it up to snuff.  The Centex homes look great, and the quality of construction looks very positive, but I worry about the location. It would be nice because I work in the Walnut Creek Park area, but everything I have ever heard is you want to stay west of I35, not to mention Manor schools are less than stellar. We also just found out that the house is acutally a pre-forclosure and supposedly the seller and the seller's agent "didn't know".   

Looking back, the seller did not budge with ANY negotiations prior to closing and in fact her agent said they would NOT pay for any repairs (including foundation problem) and also threatened to take the house off the market if we didn't accept as-is status and use our inspection to do the repairs  and relist it. Now knowing that it's a preforeclosure, we realize this was a likely a bluff.  We also think the agent initially lied when he said there's another offer , which we then inc our offer to our max. 

Was the seller supposed to disclose this info? What things should I do to protect myself? How can I find out if there's unpaid taxes or bills attached? Is this fishy or legit? The problem is the lender has rejected the appraisal because they do not like the comps.  The house was listed at 350,000 and they accepted and offer of 333,000.  The appraiser is saying he can not find any better comps.  We love this deal and want it to happen. The sellers agent has given the appraiser her comps but seems passive.  Most of the homes in the area are much higher priced because they are upscale homes on a city lake.  This house is a farmhouse but it is a 1.8 acre lot with 150 of lakeshore.  Oversized detached garage.  A funtional but old home.  3 bedroom on bath.
