I recently got an offer on my home, and the treatment I have received from the realtor has been rude, unethical, and in direct violation of common sense real estate code.  

When I received the offer we spoke by phone, and he negotiated on my behalf.  We negotiated a deal, and I sent the edited contract with my signature and initials on the changes we discussed.  The following day, I asked for contract from buyer with his initials and signature on the changes I made.  He informed me that I do not need the contract back from the buyer.  He told me since they verbally accepted the offer the contract was binding despite the buyer not signing off on the edited contract with the negotiated terms.  Currently, although the buyer verbally accepted the offer, we do NOT have in our possession a signed contract from them.  Despite this, he placed my home in contingent status and showings cancelled because of that. The last Realtor I spoke with told me to "put the keys in the mailbox and call the bank to get them."  Numerous other Realtors never even returned my calls. Then had to refi because something was wrong with paper.  We completed that on 4/29/09.  Now we are divorcing and need to short sale.  Will we have to wait to sell the home.  In my opinion the divorce was not forseeable.  I am still quite shocked that he wants to divorce.  I have an attorney, but I was advised that there may have been a clause in our mortgage paperwork stating that divorce, loss of employment or anything else that would prevent us from making our payments was not anticipated. I know builders of new construction homes often provide floor plans (and they are definitely in the business of getting homes sold), so why don't sellers and their agents of previously owned homes offer the same?

Is it just an extra expense that you think wouldn't add much to the marketing package?  Or is it just not having the time to create one or being unable to find someone who CAN create one?

Our home is beautiful, immaculately clean and well decorated (I am an Interior Designer).  It is move-in ready.  Our subdivision has a hodgepodge of homes, some very nice, others not so much.  We have had several people drive for hours to view our home after seeing it online and falling in love.  Once here, however, they walked around outside, didn't want to see inside, and we never heard from them again.  One agent showed it earlier this week and led us to believe we would be receiving an offer, but we have not yet.  He will not give us any feedback from the buyers...is this because my husband is the listing agent and the owner?  Others who have viewed the home said they loved it, but then disappeared...were they not giving their honest opinion because my husband was the agent showing it? I had all my stuff packed on a POD and the buyers backed out of contract right b4 closing, claiming county auditors sq.ft. did not match up w/appraisal, which is normal for that particular county (they include 2 story open space in great rooms, etc. in their calculations). The buyers had been in the home 3 times and inspected it thoroughly. The appraisal & inspection came in on target too. Lawyers on both sides advised against it, said contract was ironclad,but they did it anyway. Now I've been told that I have to hire my own lawyer and sue them to get anything back for my losses (I sold off & gave away a lot of my furniture, etc. to downsize in addition to moving expenses, etc.). I'm currently unemployed so lawyer fees are a tough issue right now. What was the purpose of signing a contract & hiring a realtor if I was not protected from this?
