That property has been under contract since May 11th and is a short sale. Typically, the status is shown as AWC (Active With Contingencies) in the MLS and that is more than likely the reason that it's still showing "active" on other real estate websites.

It appears that the Property Manager is ignoring you because they do not want to be honest with you. **I would start with the Arizona Department of Real Estate in Phoenix and ask them this particular question about the Property Manager and their required disclosures. Also, my best suggestion is for you to find another home to rent that is NOT ready to go into foreclosure. If you need help, I am a rental specialist and I do have one property on an acre horse property in Queen Creek that is "free and clear" with no mortgages due to a company.

I am asking some of the best tax minds in the country on this one. But, yes, because of the situation it will come down to "it depends on all the facts and circumstances". So, Destiny, I also recommend once you have my/their input that you use one of them to consult with and prepare your tax returns.
As far as the title issue, if requested, I will consult with our Underwriting Department to verify which time period is correct, as they are also experts in their profession.

Finally, Destiny, you can quit calling yourself a "Renter"; you are a homeowner, just in a unique way. It is also how you need to think when dealing with this situation, as you try to gain all the tax advantages of home ownership.
