The unit is also occupied and I would assume that these are the furnishings that the owner is using.

The answer is, "yes, of course." However, the beneficiary is typically the lender. If the property fails as a short sale (unless the homeowner, the "trustor," in one way or another cures on the potential "breach" with the beneficiary) the beneficiary will foreclose on the property and take possession. Perhaps the Realtor was referring to the second mortgage? I would need to know a little more about the specific property. Also, my assumption is one of the two Realtors is your Realtor, no? Given that you found this here on Trulia, through RealtyTrac which is notoriously inaccurate, and it's been in RT for 162 days, the odds are slim any of the three homes on that street currently active in the MLS are this home.... more

In the MLS, taxes are listed at $4607 for 2008, and the HOA fees are shown as $391 with no indication of the frequency of that payment. Utilities like water and electricity would be dependent on your usage.
