Uhmm! I'm not sure I agree with the answers below. If you have the cash to buy another house, that will be discovered as you move through the short sale process. You have to prove that there is hardship and that you don't have the financial means to pay for the house. I would definitely speak to the person helping you through your short sale before buying a home for cash. I would also ask if you will really be able to qualify for the short sale. You may be wasting a lot of time only to find out that the bank is going to deny your short sale. Going through the steps doesn't guarantee you the option of a short sale.... more
Lynn, I would agree with Dean's response below. The appraisal could have been challenged. Your realtor should have advised you on your options. One would have been for you to make up the difference if you had the cash to add. Another would have been for you and the seller to split the difference. An appraisal is one person's interpretation of the comps. I have seen appraisals challenged and changed. It sounds as though the best option for the seller was to put the home back on the market because he sold it for roughly $10,000 less as opposed to $30,000 less. Was the seller unreasonable? I think that depends on your perspective. To you, it seems unreasonable. It seems that the seller was pretty confident in the value of his home. He saw no reason to pay for an appraisal. I'm a realtor so I don't have all of the ins and outs of the appraisal process, but it seems like some mortgage companies have better appraisers than others. Consumers have been fooled into thinking there is some secret list of foreclosures. The truth is that foreclosures are listed in the multi-list just like any other home for sale by a broker. The other myth is that you will get a better deal if you buy a foreclosure. This may or may not be true. Banks are not giving houses away as much as they used to. I work with a lot of investors and home buyers. I often find that you can get a better deal with a private sale, especially from an estate or someone who is very motivated to sell and has been in the house so the mortgage is paid off.
