I AM NOT A CPA!! So take it all with a grain of salt and make sure you call someone who is much more qualified than I am! But . . . my personal experience is that you can everything you want to do. Take all the losses against your income and use the original price as the basis. There are some nuances, of course but the general idea is that it can be done. For instance, I've been receiving investment property tax status on properties that I used to live in but now rent out. I have never sold any of them, however, I have asked this same questions of my tax preparers. One question I have for you is why would you sell if you are taking a loss and can make the payments and if rent covers the monthly expense? The best real estate investors never sell . . . they just hold or 1031 exchange. But anyway . . . try this . . .
Your either talking with the wrong agents or your price is way too high and they know it but just want the listing. It seems strange to me though that they would not want to have a broker open. I think most agents are working hard to sell homes and deserve a comission! You may want to ask your self if I worked several months with out an income how could I make it!
With that said it is important that you know your options. Many sellers are writing checks to sell their homes in this market!
Dual agency can benifit you as long as you and the agent fully disclose everything about your home.
If the agent has a buyer I think that is great I think he or she deserves a comission, dont you! Most homes that are selling are lender owned!... more
