They could, but the good thing about buying a bank owned home (better term than foreclosure since it is no longer) is that the bank decides what price they will accept on he home, unlike a short sale where they don't have any input on the asking price. Let me just say that if the bank is asking $200,000 and you offer $200,000 with the bank paying $3000 in closing costs for you, what you have offered is not $200,000 but $197,000 which is lower in the banks eyes. If they receive several offers they could raise the asking price.... more
the florida contract requires allsellers to keep the property in the sam condition it was when you signed the contract. If the seller does not do that , then there is provision for the closing agent to keep 120% of the estimated cost in escrow to have the home put back to how it was when the contract was signed. Any monies remaining is then returned to the seller. Not sure how that would work on a short sale but the provision is there in the contract.... more
short sales can have bumps in the road and are not for a person that is in a rush. Just remember that putting your offer in is just the start of a long negotiation process where things like, hoa fees, MI payoffs and the appraised price can have an influance on the outcome. What I do with my investors in come up with a strategy where we have several offers in on several different shorts and hope that at least one of then will eventually close. There are several times in the process that you can back out of a short sale so if you approach with the correct expectations and mindset then it can be a good way yo purchase real estate at a discount. Having said that, more and more , banks are wanting the market price which makes it less attractive to go through all the hassel of a short sale. Please let me know if I can help you further

If time is of the essence....considering other real estate options would be strongly recommended. But if you are bent on a "short sale" opportunity, probably the best consideration would be via identifying a short sale with a "bank approved" sale price. Because most of the long and involved process having been taken care of in advance, these options can move along much more quickly.

Was the non-permitted addition disclosed? If not, you would have a good case for exiting your agreement.
Whether or not you would need to bring the addition up to code would likely depend on the extent of the renovation and your code enforcement department. They would be the best source for this information.
The "biggie" for this type of renovation is that the conversion doesn't elevate the original garage floor level to the existing floor level. Of course there can be door, window, electrical, etc concerns as well.
You would be well advised to resolve this issue prior to proceeding with the transaction.
