Divorce situations are really a mess and the wife should immediately have her attorney file something in court to ask the judge to require a different Realtor to handle the sale because it sounds like the husband and listing agent are not working in the best interest of both the husband and wife. It smells like the husband is thinking he'll short sell it to a friend and then continue to live there or buy it back. That would be my suspicion. The soon-to-be ex wife may want to let him proceed with scenario and then have him locked up for mortgage fraud! lol..
Bottom line, her divorce attorney needs to remedy this situation and if required the husband needs to have the payments automatically drafted from his bank account by court order. If he stops paying he could go to jail for being in contempt! She needs her attorney to do something immediately to protect her credit rating and her assets.... more
You posted a question, and you are an agent and you answered your own question? FYI just because a house is upside down (no equity) does not make it a short sale either. There needs to be a hardship, if simply saying you owe more than it is worth, over 50%+ of US homes would be listed as a Short Sale.... more
