Oggi is correct; however, doing so MAY create a potential tax exposure problem for you.
You see, I believe if you don't charge interest, the IRS can still tax you on what they figure you should have earned in interest. The IRS has many "interest rules" regarding making personal loans so the bottom line is that you should talk with your CPA or Tax Advisor on the best way to proceed.
In fact, if one follows IRS guidelines the setting of a loan rate actually depends on:
1) The month your promissory note is created, and
2) The term of the loan: Short-term (3 years or less), Mid-term (> 3 and <=9 years), Long-term (> 9 years).
The setting of what rate is appropriate is "controlled" by the IRS via their monthly Index of Applicable Federal Rates (AFR) Rulings, which you can see here: http://www.irs.gov/app/picklist/list/federalRates.html

I would say there is no reason a seller can't carry the loan if they sell as long as they own the home free and clear. If you have a loan on your house and sell it most banks have an acceleration clause....meaning they will demand to get paid off if you sell. With interest rates at historically low levels most buyers can obtain excellent financing for home purchases. There are websites such as Realtytrac.com or Forclosure.com that for a fee will let you know what properties are in foreclosure. Forclosures in Marin going to be few and far between. If you do find them, they will be more than likely listed with a realtor priced at market value based also on the condition of the property. You can also look in the newspaper and television for auctions. Lenders will have a weekend auction of homes at some convention type location where you can bid on them. These homes as well are not easy to get. You will be competing with professionals who will buy a bunch of properties at a time, paying all cash. You must also having your financing all in place and usually put a minium of 20% down in cash. Also, the home is sold as is, there is no inspection time, when you buy your home you will have no way of knowing what the true condition of the property is, you may be buying a real fixer that could extend way past your budget. The areas you will see forclosures are areas by the Civic Center and the Canal District in San Rafael and various areas in Novato. I don't know if you are looking to buy an investment property, but if you are I would consider looking Sonoma and Napa Counties as well. There are excellent opportunities in these areas right now. I know an agent in my office will be putting on a foreclosed condo in Novato for $260,000. It will also be on the Multiple Listing service in a few weeks. Since Corte Madera is a very desirable location and the availablity of good homes are limited this micro market has held up better than many. Prices have declined over the last two years, but good quality homes that are priced appropriately are selling relatively quickly.... more
