You can obtain the recorded documents about a week to 2 weeks after a foreclosure sale at your county's recorder's office or a real estate professional can pull the information for you at no cost. You should obtain a copy of your grant deed, trust deed(s), any assignments, substitution of trustee notices, notice of default document, notice of trustee sale notice and finally, the trustee's deed.
Once you have obtained all relevant recorded documentation as well as your original promissory note(s) then you can review them to determine that they are all consistent with the laws in your state and that proper notice and processing was performed. You will want an attorney to review your individual case with you to determine if there were any in proprietary actions or unlawful processes.

Space in my area that would be called a self help eviction and is frowned on by the legal system. They can forclose, go to court get a judgenment and lien your pay, even get your your property sold at trustee sale. They can not just lock you out. If they did my first call would be to an attorney. My second call would be to the local police.
How did you "just" find out that the HOA can take legal action? Didn't you go over your CC&R's?... more
