What is your real estate agent doing for you? He is the one that should be doing battle for you because he should have been on top of the loan and encouraged you to extend the lock in - if allowed; otherwise both your agent and the loan agent should have kept you informed. If you did not utilize an agent then this is the result of not taking advantage of a agent representation. There are many pitfalls that can happen, a ton of paper-work trail. Never go it alone. While in the middle of a transaction, the listing agent retains his status as listing agent, even if the listing contract has expired. So I understand that the buyer's agent is helping in the background, but the listing agent remains at his post.

Rental is a good way to pay off debt. However, wrong tenants can cause more debt and legal fees. Other than that you have to ask how long will the country be in this recession. if you believe less thaan a year than renting is for you. if you believe it will be at least 2-3 years to climb out of this mess. then selling is the option. You can use whatever form you want. You can even write a contract on a napkin if you want! But I wouldn't recommend it. If you are the buyer, you should have your own Realtor working for you as a Buyer's Agent. He/she can write the offer on the standard California Contract to Buy. OR you can hire an attorney to write the contract. Either way you want someone looking out for YOUR interests, whether you are the buyer or the seller. Good luck!... more
WOW, WOW, it does not matter who the listing / buyers agent is if listing agreement states from bank 6% with any amendments that what the agent would be paid. ALSO listing is agent broker.
IF broker states they are getting paid 6% then what broker office would receive
NOW if agent determine reduced commission by 2% you have NOTHING in writing then she can't .
I would be discussing this broker direct resolve issues, she can't cancel escrow due to commissions.
