To clarify, this isn't a rental property. It's a single-family home. The seller's agent happened to mention that a "family member" was living there.
I understand the need to protect tenant rights. It just seems that it would make sense for a seller disclosure of any lease agreements to be part of any purchase agreement. Any seller could be renting their home out and even their agent might not know.

If you are interested in buying it, I would contact the landlord and the bank and find out if short sale or an assumable loan are still possibilities. The bank likely does not want to sit on another property that may not sell. It also saves the landlord from having a forclosure on their credit and saves the bank from going through the courts to properly evict you.... more
