Real estate agents are way over paid. Everyone deserves getting paid, but 5% for what? They are paid more then doctors that save our lives and with only a high school education. There is no way selling a home for 100K and giving the agent 5-6K. I sold both my homes myself and just advertized and had open house and a lawyer for $600. Not worth thousands.... more
For many years the State of Florida assumes the consumer public knows that all agents are considered "Transaction Brokers," who have limited duties and virtually almost no liability in a real estate transaction. When an agent tell a seller or a buyer that they will represent them eclusively, the State requires written disclosure via a Single Agent Disclosure form. If a conflict of interest arises and the seller's agent obtains the buyer, most often the seller's agent will then want to revert to a Transaction Broker and not represent the seller or the buyer. Some offices reguire their agents to work only as "Transaction Brokers" because there are so many agents in the company that the broker or manager can't possibly keep track of the problems and liability which could arise when they have 700 or 800 agents in their office trying to represent buyers and sellers. It was much easier to take the liability away from those brokers and make all their agents "Transaction Agents" who have little if any liability in the transaction. Some office even go so far as to train their agents to say, I can't say or I can't say or I can't say because the Transaction Broker is suppose to be unbiased.
