good afternoon...you are still due the child support arrearage even if the house is foreclosed upon...the lien is just supposed to be added protection for you...encumbering a financial interest he has to be sure you are paid......the lien will show on title and have to paid in full at the closing, or at you and the court's discretion, either released or paid down....or paid off....what needs to be determined is if he will be getting any proceeds at closing...if it approaching forelclosure...he will probably end up with nothing.....or loose the home or both...i suggest sending the judgement against him for the support arrearage to the florida dept. of treasury and the irs to capture any refunds he may be entitled to....you can also subpoena his bank records and garnish not only his accts. but his paychecks...i hope that helps....bob mcclure- mortgage now- farmington, michigan....licensed in 22 states including your's... - Wed Nov 12 2008, 13:47

good afternoon...if you sell at the going market rate now, would you loose more $ than you would gain by buying right and fixing the new purchase after the market comes back?......if so, stay in your existing home....also, you can pull some cash out of your existing home to purchase the new one....it would mean leasing your existing home and keeping the new payment strong enough to debt service the new monthly payment...then sell it when the market returns....remember, when qualifying for the new home...whatever the new lease states you willl be collecting for rent, 75% of the lease is what is used to help zero down the new payment when qualifying for the next purchase......i hope that helps....licensed in 22 states including your's.....bob mcclure- mortgage now- farmington, michigan........ - Fri Oct 24 2008, 13:07
