I would just like to mention the little peninsula town of HULL a/k/a Nantasket! You can get a LOT of house in your price range (probably ocean front!)

And forget bicyling alone....you can WALK to a beach no matter where you live. And the best part...you can take a short boat ride to and from work each day!

MASSACHUSETTS CONSENT TO DESIGNATED AGENCY

Hi Pete!

I am a Licensed Massachusetts Real Estate Agent and I think I can clarify this for you a little. In MA, licensed agents are required to present a Massachusetts Mandatory Licensee-Consumer Relationship Disclosure at the first personal meeting to discuss a particular property. This form explicitly states that is "Is Not a Contract". It is provided to you, the consumer, to assist you in understanding the relationship...at that given moment in time...between you and the real estate agent. If you are meeting to discuss or visit a home for a possible PURCHASE, the "Buyer's Agent" option will be checked. Likewise, if you were meeting to discuss the possible SALE of your existing home, the "Seller's Agent" option will be checked. You as the consumer are not required to sign this form...and there is even a place at the bottom of the form where it states "Check here if the consumer declines to sign this notice." Regardless, all MA licensed real estate agents are required to present this form at the first personal meeting.

Having said that, it sounds like you were asked to sign a different form all together..."Massachusetts Consent to Designated Agency". This is still not a contract....it simply means that the agent named on the form...no other agent in the office.... represents you in the transaction....IF you decide to use that agent to write up an offer.

Now, to answer you question....unless you signed a contract titled something like "Exclusive Buyer Agent Agreement" you are NOT bound to use one realtor. For obvious reasons, however, if a real estate agent is taking you around and showing you homes, that agent is very well assuming that you enjoy his or her company enough...and are satisfied with the services being provided to continue this "assumed" buyer agency relationship....to eventually buy a house with that agent. Afterall, we do work off commission.

If you are in this latter position, and you are not satisfied with the services thus far, it really is the fair and ethical thing for you to do, is terminate the "assumed" relationship.

Sorry for the long-winded answer, but it really must be very confusing to consumers like yourself all this talk about "agency" and "what are your obligations to a realtor" etc. Basically, if your agent is not giving you the answers you are looking for, or if you are confused in any way, talk to an agent that will explain this detail to your satisfaction....as this is only the tip of the iceberg in a very complicated transaction!

In real estate, every transaction is unique. There are many variables that determine how much to offer vs. how much the seller will accept. If you have concrete statistics that demonstrate why you are justified in offering 20% below asking, go for it. A good Buyer Agent (who represents YOU and your best interest...i.e. negotiating on your behalf for the best price and terms) will assist you in determining what is a reasonable offer. Of course, only the sellers and their agent knows what their bottom line is...so all the information you present may be useless....you never know unless you try!!!
