In NJ the three day attorney review period allows either party to cancel the contract for any reason during that time period, no explanation required . If the seller gets another offer, they can kill the contract they have with you and just accept the other offer or they can ask both buyers to submit their best and final offer. I’ve lost deals in the attorney review period and understand how heartbreaking it can be when you have the rug pulled out from under you. I will say that in most cases my buyers have ended up getting a better deal on another home, some thing are just meant to be.

Hi Phil,

As long as your home will still appraise for the $592,000 you owe should have no problems. Your interest rate may be a bit higher then the 6% you have, but it may be worth it to you to lock it in. Call your lender and work the numbers with them. Depending on how long you plan to be in that house, it may not be worth the costs involved. - Wed Aug 27 2008, 05:35

It would be highly unethical for the agent to do this. If you really want to be sure your offer was submitted to the bank, have your agent write up an “Acknowledgement of Presentation”. This could be a very simple form attached to the contract asking that a representative of the bank sign and return to your agent verifying that they have received your offer.

You would have to check with the home owners association. Chances are that the community will not allow it. You would then be required to either sell or rent (if rentals are allowed) If you need the phone number let me know which community and I'll get it for you.

You'll have to make a trip to MVC to get the title transfered to your name.
