About Me
I have been a licensed real estate agent, serving Twin Citiies of Minnesota home buyers and sellers since 1994. Buyers Real Estate Group has afforded me the opportunity to be an Exclusive Buyer Agent since 1999.

While traveling for many years as a performer, I developed an interest in historical architecture and home design. Combined with my communication skills and attention to detail, a career in real estate felt like a natural transition.

After extensive real estate training and earning my Graduate of REALTOR® Institute distinction (akin to a master's degree of real estate), I joined one of the top real estate sales teams in the Twin Cities. Through that experience, I learned the value of providing representation to only one side of the real estate transaction. I am among the first class of real estate agents to earn the Board sanctioned title of CBR, Certified Buyer Representative as well as the Real Estate Buyers Agent Council of the National Association of Realtors' distinction of Accredited Buyer Representative (ABR).

The necessity for disclosure required by our state and federal government, combined with the particulars of finding a property and negotiating a purchase agreement, make a real estate transaction complex. If you wouldn't handle a real estate deal for a friend or neighbor, why would you risk your own financial security by not having a professional EXCLUSIVE buyer agent?

I had a short sale transaction this year that went over 3 months without a response. It was a full price offer. When we did get a response over 3 months later, it was a rejection! No counter offer, no nothing. When I did communicate with the seller agent (who was very difficult to deal with because of lack of communication) and asked what price the bank was looking for, she responded that they wanted a price $50K over the list price they had on the MLS. I know some short sale banks won't even negotiate unless/until they have more than one offer on the table (we got rejected the day after another offer came on the table, but that offer didn't go through either). Another school of thought is that the bank is stalling until the end of the redemption period so they can file on the insurance (if it was an insured mortgage) on the home after it's gone in to full foreclosure. Be aware, in the state of MN, according the Contingency Addendum put out by the MN Association of Realtors, the only acceptable form of contingency removal is a valid signed fully executed purchase agreement on the back up house. In other words, the buyers cannot come back and say they have "other funds" that allow them to purchase the home even if they don't sell the current one. If they had such liquidity without putting them in bad financial straits, they would have written a non-contingent purchase agreement to begin with. - Mon Sep 22 2008, 12:10
Do you mean a purchase agreement contingent on the sale of the buyer's other home? Well, only if you're still allowed to continue to show your property, which is the way it usually occurs. Make sure there are specific provisions for how the contingency will be removed and how you can alert them about another offer on your house that you'd like to entertain, thereby giving them a time limit to remove their contingency.

Do you have an agent? Your agent should be giving you advice about these things! There is an elevated level of risk with contingent offers just because there is an additional layer of "what ifs" to be determined and worked out now and in the future. And, stuff can always go wrong with an elevated level of risk.

Yikes! That stinks! Not knowing how your purchase agreement was structured, I can't say for sure how it was "supposed" to go. It's my understanding, according to the standard FHA addendum (depending on which option is checked, because there are 2 options), that if you provided a written statement from your lender that says you had final underwriting approval and then DIDN'T close, the seller can keep your earnest money for liquidated damages. Is that what happened? If so, they have every right to keep it. If you checked the first option or if you have not provided a written statement, it's pretty clear that the earnest money is refunded to the buyer if you cannot secure financing. You need to ask your agent for some specifics about this. If you find out that your lender provided that "Written Statement", then I would start pressuring your lender to give you your earnest money, especially since another lender seemed to get the spot approval without a problem. - Mon Sep 22 2008, 06:44
