My name is Christian Melby, Broker/Owner of Melby and Associates, LLC. I run a Massachusetts residential real estate brokerage located in Milton, Massachusetts. We offer brokerage services on Boston's south shore.

We offerian a la carte listing model, in which clients pick from a menu of real estate services and are billed only for the services selected. The menu includes minimal service to traditional full-service for full-fee options.

I am also a state-certified real estate instructor, and I teach the real estate salesperson prelicensing and continuing education courses.

Very simple, very short, very direct: I would ask him to get into his spaceship and blast off. If pressed, I would tell him that I don't work for free, I don't give expert opinions with no expectation of payment, and if I don't list it, I don't bring buyers to it. - Fri Aug 8 2008, 09:25

It makes no difference if the seller declined an offer from the buyer previously. I repeat, that prior offer is dead, and the entire process starts over with the new listing. The listing broker and brokerage did absolutely nothing wrong. The seller can make absolutely no claim or exemption and has no right to claim such regarding the buyer. The listing broker and brokerage have nothing to defend or be ashamed of.

No brokerage should ever sign a contract that allows the seller to find the buyer and not pay the commission. That is pure suicide. Why should a real estate brokerage pay the marketing fees, spend time promoting the home, do open houses, etc. and then have any chance of compensation for time, expense, and effort disappear because the seller found the buyer? How many times will the buyer attend the open house and then approach the seller directly, ask to buy for a lower price directly, and how many sellers will try the old end run to save the commission? Most.

Call the broker and try to wangle a deal by hinting at lawyer action? Ridiculous. If contract says the brokerage gets paid, the brokerage gets paid. The brokerage is fully within its rights, assuming they have used the standard contracts that do not have any exceptions for previously declined buyers, to be paid fully. - Thu Sep 11 2008, 08:19
You signed a contract with the listing brokerage saying that you would pay them a specific commission if, due to their marketing efforts, they procured an offer that you accepted.

The previous deal with the entry-only brokerage was dead when you rejected the offer for lack of sufficient price. Since you were dealing with an entry-only listing company, the usual broker protection period does not apply.,

The whole situation starts anew when you hire the listing brokerage.

Sorry to say, if you accept the offer from the parties you earlier rejected, unless there is something in your current listing contract that absolves you, you owe the listing brokerage the full commission. Also, if the listing brokerage has used standard forms, you owe the listing brokerage the entire commission if you accept an offer from that same buyer for X months (X depends on the language in your listing contract) AFTER the current listing contract has expired.

Yes, you owe the listing brokerage the full commission, and the listing brokerage owes whatever they promised in MLS to the selling brokerage. - Wed Sep 10 2008, 19:10
