About Me
I am a licensed real estate broker in Kansas (and also Colorado). I actively marketed real estate from 1986 through 2005, when I took the position of a branch broker and manager at Coldwell Banker Griffith & Blair American Home in Topeka, Kansas. I continue in that position, but in January of 2008, also took the position of C.O.O., assisting the President in the operation of the real estate company.

I'm a bit confused. In order for your nephew to borrown on the property, his name would have had to been on the title. I am guessing his name was on the title with yours? The he borrowed, signed a note and a mortgage, and you signed neither the note nor the mortgage? Usually they would ask you to sign the mortgage as a co-owner (no obligating you for re-payment on the loan, but making foreclosure would be simpler because the mortgage is the security instrument that pledges the property as security on the loan). How is it that it is valued much less than what your nephew borrowed? Banks almost never want to own property but they do want to receive what is owed on the loan - or as much as think they can possibly get. I might consider a real estate appraisal on the property, but first I would talk to a knowledgeable real estate attorney in your area. Good luck! - Sat Oct 11 2008, 22:21

In Topeka, one of the MLS selections for an agent to check is "frame" which means a wooden frame house (most houses). If it was partial brick, it would say "brick and frame." If it was brick, it would say "brick." Likewise for stucco. Hope this helps you. - Sun Sep 21 2008, 16:37

This is a time for you to rely heavily on the advice of your Buyer's Agent - to provide you with information about the current market, history on that particular property, recent & comparable sales, etc. What you can expect from your buyer's agent is J.A.C. = judgment, advice and counsel. - Tue Aug 19 2008, 14:08

During all my years of actually marketing, listing & selling property, my specialty was providing professional representation to buyers and sellers of residential real estate. I also represented one seller in the disposition of two large, commercial properties in Colorado, which is what prompted me to obtain a Colorado Real Estate Broker's License.
