No they are not considered Condos, but 'PUD' which stands for Planned Urban Development. Homeowner associations are formed so that residents continue to adhere to the CC&R's established, such as the up keep of common area's, a club house, neighborhood appearance etc.
Some Homeowner Associations have restrictions which will limit or control the amount of remodeling of a home including exterior changes (increasing the size of a home for example).
During the process of buying a home the prospective buyer will have to review the CC&R's, sign and agree to them prior to close of escrow. Should a buyer wish to know in advance of making an offer they can ask their Real Estate agent to help them obtain a copy of the CC&R's in advance.
Maysmom: Great question. Of course you've picked two of the hottest if not the top choices for Fremont. Yes Ardenwood is lovely, newer and the elementary school scores are very impressive plus value retention has been excellent. As for the Mission - long sought after area with top notch academics standards. The mission also offers quicker access to the south bay via Highway 680 and 880, where Ardenwood makes a commute to SF and Sunnyvale quicker via Bart, train and bridge.
Ultimately you need to weigh the particular choice of the home. Age, condition, location in neighborhood, access to schools and costs.
Identify one or two properties in each area and then working with a Realtor who is familiar with your goals and objectives you should be able to pick the better choice for you.
