There are several good attorneys in Cartersville and Acworth area. I can recommend a couple if you would like to email me. Concerning you Radon testing, I would find a person that specializes in that and ask for information and cost on what it will take to seal out the radon. I have not had an experience with radon before but have a name of a inspector that may be able to help. Did your inspector not recommend a company or what needs to be done to fix the problem. I have a home listed that has gone into foreclosure and the bank allowed the renters to stay and pay them rent and take care of the house until it sells. Once it sells they will have to move out. If you are the owner, then the bank will require you to move out at or after the foreclosure sale. You will not by law be allowed to stay in the home. If your property is being advertised now, the add runs for 4 weeks then will be sold on the first Tues. of the following month. If it sales to the mortgage company or bank for less than what is owed they do have the right to sue you for the difference. Hope this helps and good luck to you.

Hello Dana,
In todays market there are sellers welling to do a lease purchase, whether they are builders or individuals. This is the typical sernio for a lease purchase from my experience. The seller will require that you visit with a loan officer, a letter with explaination on why you can not purchase today but when you can purchase under certain guidelines. They can not promise a loan in the future but will give guidelines on what needs to be done to meet their requirements for a loan. The seller will require a 5 or 10 percent NON REFUNDABLE Downpayment. This should go into a Trust Account and not be touched. Never give this to directly to the Seller. This gives them the security that you are serious about a purchase and not just renting. If you do not close by the contract date then this money goes to the seller. Normally your rent is not applied to the down payment or the purchase price as it will be just enough to cover the Selller'snterest payment to the bank , insurance and taxes or the mortgage payment, which in most cases will cover their interest only payment. There is no reduction in the principle amount. You are basicly renting the home you plan to purchase. Beware that in some cases the Seller is using the rent payment to cover his/her personal expenses and not making the payment, they will eventually be foreclosed on. Then you will be forced to move but the Earnest Money payment would come back to you in this case. Keep in mind that by working with an agent, you can request that the earnest money be held in their company trust account for safety. I have one lease purchase now that is about to close but over the years the success is rare. My recommendation to you is to rent and put what money you have saved into a interest earning CD so it can be working for you and not someone else. Then when you are ready to buy you will be a ready able buyer with more power in your court. A Realtor can help you with that, most have some listed. The local Home Builders Association has a directory that they will email you with the names of builders and developers, call them they are all trying to sell their lots. Call the banks because we all know they are sitting on a ton of foreclosed lots in subdivisions. If you want to come up to Cartersville, only a 15 minute drive north I-75 , I have some beautiful lots in two neighborhoods that are steals. They are great investments if you can afford to keep up the property taxes and hold on to them for 3-5 years. There are 120,000 dollar estate lots that Regions is accepting contracts for $29,000. in one of the neighborhoods I am selling in. It will be better than the stock market when it comes back and it will come back in a few years. Let me know if I can help you. - Wed Jul 23 2008, 16:21

Today that should not be a problem as so many builders are giving back their lots to the banks and some are being forclosed on every week. If you would like to come up the interestate 75 to Bartow County I have plenty of lots to sell you at a great price in very nice neighborhoods. Once the banks have forclosed on the lots they usually place the lots with a Realtor to sell them. In that case they should be coming up on MLS and FMLS under residential developed lots. Second, call the banks, Regions, SunTrust, ect and ask to speak to the person that deals with builder construction loans, this person should be able to help you and believe me if they have lots they will roll out the red carpet for you. I personally know of 2 builders in Cobb going thru this and the banks have their lots, very nice subdivisions. It won't be hard to find just your effort .
