Hi there,
Some of the lenders out there are requesting the buyer to put the utilities in their name during the inspection process. I would not have recommended that you do an inspection without the utilities on. You should not have to pay the water bill. You should have them come out and do a final reading. Then at time of closing if bank owned which I am assuming. It would be put on the sellers statement to pay the remaining balance. Your agent should have this in their purchase agreement. If you do not have an agent I would suggest that you get a buyers agent to represent you in this matter. Good Luck - Thu Jul 31 2008, 10:18

Hi Sarah,

In reference to your question. Have you put an offer on a property already? Almost all purchase agreements have financing and inspection contingencies already built into them. I do agree with the first answer though if you do not have an experienced realtor working on your behalf I would be happy to suggest some qualified professionals in your area.. So, the answer to your question is no the seller does not have a right to your funds. Although, if you are approved and then decide to back out of the deal they can keep your deposit. I have to agree with the other 2 responses. In the last two years we have seen a large shift in our market here in the Michigan Area. I also have this same sitution for I live on 15 acres and my home is very difficult to comp. I have found that many appraisers in that situation have to go a little bit beyond my area to get accurate comps. You may try another lender and there appraiser would be different. I wish the news was better but with the market in Michigan declining the past few years the values have gone done substantially. My personal residence was appraised for 395,000 3 years ago and is now appraised at 310,000 so i do understand. The good news is some of the areas of Michigan we are seeing growth and being removed from the status of the declining market. So, hang in there. - Wed Jul 2 2008, 08:31

Well, there are many differenet variables. Claiming bankrupty is one. There is also possible loan modification with your bank. Who is your loan through contact the asset manager before foreclosure.
