About Me
I entered the real estate business in 2004 after a 20-year career in customer service in the typesetting industry. I am a near life-long resident of Jackson County, Georgia. I hold the ABR (Accredited Buyer Representative) designation, and my favorite part of working in real estate is working with buyers. I am a member of the National Association of Realtors (NAR), the Georgia Association of Realtors (GAR), and the I85 North Board of Realtors. Personally, I am involved with Relay for Life, a member of Watkinsville First United Methodist Church where I sing in the chancel choir. I am an avid Atlanta Braves and Georgia Bulldogs fan, and enjoy SCUBA diving and making handmade greeting cards.

In my experience, in a short sale, the lender is essentially selling the home "as-is" and "where-is", much like a foreclosure (i.e., no Seller's Disclosure Statement, etc.). The lender has no control over how the seller leaves the home. As the lender is a bank or mortgage company not even in the same area as the home they have no idea what condition the home is in when the contract is approved. Lenders have said to me when asked about appliances that the price/contract includes "whatever is there." My experience is in Georgia, and I am not familiar with the laws in California. As suggested by Debra, your best bet is to contact an attorney and let him/her look at the contract to see if there is any sort of breach because of the absence of the appliances. - Wed May 21 2008, 08:25

I agree with most of the answers so far. I am not in the New York area, but all over the country if you have good credit and don't have property to sell before you buy, now is the PERFECT time to buy. Prices have already fallen, interest rates are at a near all-time low. Look at it this way, the time you know that prices are at the absolute bottom is the time when they start increasing again. If you can find the home you are looking for, work with your Realtor and make an offer. Keep in mind that you should always be willing to walk away from any deal unless you are comfortable with the price and the terms of the loan, etc. Good luck! - Wed May 21 2008, 08:01

My personal opinion is also to pass the bonus on to the Buyer. You are, after all, representing them and Code of Ethics says that you put their interest above even your own. You could, of course, advise them of the bonus offer and tell them to make the offer lower and include in the special stips that the bonus be passed on to the buyer. In Georgia, the bonus must be approved by the broker anyway, and often the broker wants to get his/her cut of the bonus as well - depending on your contract with the broker. - Fri May 16 2008, 08:52

I agree with the others who have answered before me. Look carefully at your contract to see what options the Seller has in your case. Generally, at least in Georgia, the consequences of defaulting on the contract are spelled out in the body of the contract itself. Also, since your Realtor is not an attorney, check with one to make sure that all your options are being checked out. The Seller can possibly pursue the specific damages route, that will depend on the specifics of the contract. You are probably right about losing your earnest money, and sometimes it is stated in the contract that if the Seller accepts the earnest money, they are not able to pursue for specific damages further. - Fri May 16 2008, 08:49

Bank of America Closing Costs

I have a client who is using Bank of America no fee loan. They are getting a competitive rate and BofA is paying most of the usual closing costs. Their closing costs will basically consist of Escrow Establishment charges (homeowners insurance, taxes, etc.) and Prepaid items (prepaid interest, etc.) - Fri May 16 2008, 08:41
