First of all maybe I said it wrong. I completely understand that it "can" happen. There are situations where a second agent can come in and write a contract and get paid a commission. I was being specific to the person's question when they said they seen the property with an agent, they really like it and now they want another agent to just walk in and write the contract. I was referring to the basic definition.

The code says it right there and it's what I said.

Appendix II to Part 10 of the Code of Ethics and Arbitration Manual gives a basic definition of procuring cause as “the uninterrupted series of causal events which results in the successful transaction.”

If I had a buyer tell me that they seen a home with another agent and they wanted me to write the offer, I would seriously sit down with them and get an idea of what happened before I just write the contract and assume nothing is going to happen. Be prepared to sit in front of the Prodessional Standard Board.

If you took the time to show someone houses, stayed in touch with them and all of a sudden you find out that I wrote a successful contract for the people you showed the house to, you would just chalk it up and not file an arbitration?

That's all I'm saying.

My suggestion to you would be to find another agent you would like to have represent you. I would also contact the first agent, either by letter or email explaining your situation and the reason why you don't want them to represent you any further. Procuring cause is an event of uninterrupted series of events.

If the buyer called the agent to show the property, the agent showed the property and the agents "continues" to follow up on that property then it's really hard for another agent to get involved and write a contract and expect a commission.

That would really make a lazy agent even more successful by having their client (the buyer) go out and look at properties with other agents and "just call me when you find a house". - Fri Nov 7 2008, 11:32
Did your agent set you up on the Prospect Manager, through the MLS? That way you get the new listings emailed to you everyday.

Buyer's, as yourself, do tend to look around at other websites, even though the Prospect Manager will more then likely be sending you the listings anyways. - Fri Nov 7 2008, 10:52

I'm sorry you're going through this, but "yes". As long as you didn't sign a buyer agent agreement with this agent you can find another agent to represent you. The only thing is that your new agent probably wouldn't get paid a commission if you end up writing an offer on a property that the first agent showed you.

You need to contact your real estate agent and have them set up the appointment. Get, either the adress or the MLS number and have them set up the showing. You shouldn't be trying to set up appointments. That's the job of your agent. - Thu Nov 6 2008, 17:30

Showings are very important in this tuff market. Make every showing count and don't leave any excuses for the buyer to make.

I would refinish the hardwood floors and make it look nice. It may actually be cheaper, "BUT" understand...Refinishing your floors is a maintance issue. It's not going to add value to your home. - Thu Nov 6 2008, 09:43
