what is pre-foreclosure?

J. R. Lewis answered:
This usally refers to the period of time between the filing of the Notice of default and the actual date of the trustee's sale. Not all properties in pre-foreclosure end up forclosed. - Fri Aug 15 2008, 15:21

Dear Vicki,
Unfortunately I don't know anything about Davis Foreclosure, but I strongly recopmmend you attend the workshop. At the very least, I think you will find they will provide you with helpful information regarding the foreclosure process and the options available to you. I applaud you for being pro-active to save your home and wish you the very best.

Dear Tien,
I know it sounds crazy, but this is the way the banks operate. They will anly deal with one offer at a time, even though, yours may well be a better offer. I'm sure your agent wishes they would look at yours, but he or she is telling you the truth. That is just one of the reasons that short sales are so frustrating for all invloved. Good luck and I hope that you and your agent can find the right property for you. - Wed Apr 2 2008, 16:58

J. R. Lewis answered:
There is one very important law you need to know about. If you are planning to buy a property on which a notice of default has been filed and you, yourself, do not intend to occupy the house, you must use a special purchase contract that includes a right of rescision for the sellers. Buyers and agents that have violated this rule are being taken to court and can face both civil and criminal penalties. My advice is to consult a realtor, who understands this very important law. - Thu Mar 20 2008, 15:37
