140 Murray Hill sold for $253,500 in April and in May 156 Murray Hill sold for $226,500. 145 Murray Hill is not scheduled to close until July 10th, so no one is able to disclose sale price until it closes.

I think Tman is putting too much emphasis on this issue. Comparing it to a VIN # which is a vehicle's legal identification certainly is fraudulant, but does not equate. - Fri Jun 13 2008, 06:36
This is more of a marketing ploy in most cases, than unethical behavior. Often times you want your listing to get noticed, especially if there has been a change or something. In Atlanta, the tactic is not usually to withdraw and relist, but to relist with a new # when the initial listing term expires, versus the alternative of extending it. - Fri Jun 13 2008, 04:26

I am finding not all agents are aware of this. There is now a separate disclosure form to fill out with your contract too.

Do you know if any of your fixtures as low flow? You could purchase and install aerators for the sinks and low flow shower heads since you want to "do the right thing". You can purchase low flow toilets for about $150+ and we have a list where there are rebates. I think a plumber charges about $150/toilet for installation,

I would be cautious about changing fixtures, as buyers will then want to select the fixtures for aesthetics. Perhaps you can inform the buyers and have them purchase the toilets and you pay for or split the cost of installation. Since you are past due diligence however, it is not your responsibility. However, one could argue you did not disclose an adverse condition, so I would suggest treading lightly. - Fri Jun 13 2008, 05:01

95% of list - am I crazy or is the seller?

Yes, often within the 1st 30 days, sellers are still hopeful - which buyers may see as delusional. I think 95% of list is strong. It only leads me to believe that there may have been other terms in your offer you have not disclosed. Otherwise, I see below that you noted they lowered the price $20k. So why not come back at full list now??? I usually tell people to make decisions based on what is in their heart. If you want the house in your heart and the price is now right, don't let the past stand in your way. - Fri Jun 13 2008, 04:45
