Effects of backing out of a new construction contract?

Elizabeth, are you sure your new home will still appraise for it's contract value? Did you guys go nuts at the design center with too many upgrades that you are now re-thinking? It can happen. Every builder's contract is different for new construction. They don't typically use our Texas Real Estate Commission standard contract. Read the fine print carefully to know what is at stake. If you didn't have an agent representing you at the time of purchase, that doesn't stop you from having a conversation with an agent now. There are questions we can ask that would not be appropriate in a public setting to help you determine if this is just cold feet or if you really may have over-purchased. Better to deal with it now - and the sooner the better. I just helped one couple get out of their home (different circumstances) six weeks before their home was finished. They did forfeit their earnest money and almost half of their upgrade money because the house was almost complete. Have also gotten people out of the contract much earlier - in the first few weeks and before the slab was poured - where the builder just handed back the earnest money and wished us well. You never know for sure how it will go, and it doesn't hurt to try to get at least a portion of your funds back. - Wed Nov 12 2008, 12:08

I just want to throw this out there in case you are considering resale in Southlake, too. Builders, like Team 3 Homes, are doing renovation projects and not just new construction of custom homes. These builders in Southlake are so creative and are used to working on million dollar properties. If you find a resale home that is 80% of your criteria, talk to some of the builders about taking it the rest of the way to what you envision. Townhome and duplex products in Frisco haven't shown to have high rates of return in the short-term, but they are a relatively new product to our area. We are mostly single family homes, and in some cases you can buy a 4-bedroom single family home for less than a 3-bedroom townhome. Rule of investment is to make the wisest purchase with the greatest potential at resale. In Frisco, that still points to single family homes. - Wed Nov 12 2008, 11:46
