As an avid golfer and resident and former women's club champion of Ford's Colony, I have a unique understanding of the needs of my golf community home buyers. I am a Virginia native, but I spent 20 years in the Philadelphia area. So I relocated here in Williamsburg just as you are planning to. In Philadelphia, my career was in healthcare management with my most recent position as Business Manager for the Division of Cardiology at Jefferson University Hospital.

My background gives me an edge over my competition. I'm a graduate of the University of Virginia and also Wake Forest University (MBA). I've held very responsible managerial positions, and technology has been sort of a hobby for me since the original IBM PC. What does a guy in Burbank, CA know about Williamsburg, VA real estate? I'm surprised by your comments. You have NO knowledge of our market. Gail has exceptional professional representation. There are 21 comparable properties in Kingsmill alone, and only 4 have sold in the last 3 months. The property in question was significantly overpriced when originally listed a year ago. Of course, who could predict that the market would tank the way it has.

The home is now well priced, and it should be one of the next to sell. LIke most of the sellers in today's market, Gail is very nervous.

As the current listing agent of this property, I can assure you that this homeowner is very well represented!

Your home is very well positioned, price-wise. I know it's below appraisal, but many homes in our area are now selling below appraisal... and even below the county assessment sometimes. There has been a lot of traffic through your home, and you have been the "bridesmaid" on several occasions. Your home has the advantage of the 1st floor master bedroom (many of the other townhomes on the market do not have a bedroom downstairs).

Kingsmill is very desirable, but the townhomes are old and there are so many new townhome choices for much less money. Braemar Creek is one that offers major competition, and there are several others in our area.

There are currently 21 of these smaller townhomes (Littletown Quarter, Archer's Meade, & Winster Fax) on the market. 11 have gone under contract so far in 2008, but only 3 in the last three months. Buyers are out there, but they just aren't pulling the trigger!

I believe your home will be one of the next to go! Maybe even someone who is reading this post will have an interest. The virtual tour link is shown below.

Before I respond, I do want to recommend that you speak with a real estate attorney about your options. I am an agent, not an attorney.

Did you receive your HOA documents? If not, then you can use the HOA documents as your out.

Otherwise, you should speak with the builder and level with him about the situation. I'm assuming it's one of the large builders. It's only been month, and he can probably sell the house to someone else.

At the worst, you might be out your deposit. The builders could theoretically sue you to perform under the contract, but they typically don't hassle with that.

If he wants to collect "missed marketing opportunity", then he needs to quantify that. It's only been a month! And a month doesn't result in many sales around here right now.

I'm sorry that you are having this issue, and I hope you can find a way to resolve the situation. Probably forfeiting you deposit is equitable. You did sign the contract, afterall. Hopefully, you can negotiate a satisfactory solution with the builder.

John, our area has one of the lowest foreclosure rates in the country. I don't think your advice applies as much in our area as it does in other parts of the country. Are you talking about the house on Fords Colony Dr on the golf course? Do you have an agent? I wouldn't want to step on your agent's toes!
If not, then I am happy to assist you with this home. The builder passed away and his son is now running the business. He has several homes on the market right now. The price on this particular home is down from $872,500. Let me know if you want to get in to see it, and we can discuss the price when we looking at the house. I'll give you a summary of the other homes that have some in the last few months and the similar homes that are currently on the market.

The cost of construction depends upon the neighborhood in which you build. Some of the communities have very strict architectural guidelines that drive up the cost of construction (Ford's Colony, Governor's Land, Kingsmill, Stonehouse). In these higher end communities, you can expect to pay between $160 and $200/sq ft. In Greensprings West, you might pay a bit less. Land in these communities is expensive and you need to add at least $150K for your lot.
I'm not sure where $100/sq ft comes from. I know that number must have come out of a book of some sort, but it's not close to reality. You might be able to put a modular home up for $100/sq ft on a more rural lot.
