About Me
Options Realty offers all that I hope to embody as a real estate salesperson. My primary focus belongs to the consumer- adhering strictly to my fiduciary relationship with my clients is above all else. Have your lawyer review your contract for timelines that the builder has agreed to. Your recourse, if a timeline passes, is likely limited to being able to cancel and get your deposit back, but have them review it for you and see if there are any loopholes available. My GUESS is that you're seeing the huge newsday ads that offer 2%. I don't recall whether or not the fine print includes the reality that this is their PART of a TOTAL fee paid by you; what it does not include is the selling side (person that brings your buyers) fee.
If it's 2% if THEY bring the buyer, understand that they are not working "for" you at that point; you'll be in a dual agency situation with them, in which they can offer little more than "you decide" when issues re. your transaction come up. Less than helpful, and not what you signed up for (unless you know and accept this beforehand). If you're fine with limited exposure, and that scenario, it's a good offering.
My problem with an ad like that has nothing to do with what they charge; it's the fact that people like you are forced to call them to discover that it's nothing more than a well disguised larger amount, IF you want full mlsli exposure with someone representing your interest. If they're deceptive in advertising, I'd think twice about their overall practices when selling something like a house. Just an opinion.

Peter, use an agent that understands the importance of offering buyer agency on your property; understands the issues inherent with dual agency, so is willing to forego the selling side that you'll be paying in commission in order to offer you full fiduciary (loyalty, accountability), and doesn't look at you "funny" because (at this point) you know more than they do. Trust is a feeling; selling a house is business. If this person is a town over, so what. Price it right and while it may still require a wait, at least you know that this person has taken the time to understand what is in your best interests. You might be astonished at the # of agents in NY who don't have a clue- find the minority that understand what fiduciary is. If they can spell it, you're probably home free. - Tue Oct 21 2008, 15:04
