"I am writing on behalf of Rebecca Dowty who was our Realtor in the purchase of a Condo in Wichita. I can honestly say that she is the best REALTOR that we have ever dealt with and we have bought and sold several homes over the years. To back up that statement, I offer the following:
1. I called her at the last minute to show us a Condo and she was there within 15 minutes with a host of information about the Condo and the area.
2. Wanting to see more Condos, she quickly lined up several in our price range, emailed the particulars and we were able to choose which ones we wanted to see, which we did in short order.
3. Once we decided to purchase a Condo, we made a low ball offer which she didn't hesitate to pursue even though she knew it probably would not be accepted. Although it was turned down, we quickly made another offer and arrived at a price almost $10,000 below the original asking price.
4. Once the price was agreed on, she followed up on all the necessary actions required in the purchase because we live 1100 miles away. She hired an inspector for us and personally went along with him to check out the property. She coordinated things with the Title Agency and made that a painless process.
5. All of the above were done immediately - usually with a few hours, getting back to us each step of the way, even if it was late at night or early in the morning.
6. Once the sale was complete, she made sure that we were pleased with each action taken and she even went over and turned on the light, so that our night arrival would be more pleasant!
7. Since then she has contacted us two or three times to see if we are satisfied.
In summary, I don't think that you will find a more professional, dedicated and hard-working Realtor anywhere! I know that should we need Realtor services in the future, she will be the first one we will contact.

"We didnt have much notice when my husband was asked to transfer from his work in Alabama to Kansas. I asked a close friend (who is a Keller Williams agent) to help me find a REALTOR in Wichita who possesses strong professional ethics. She referred us to Rebecca Dowty.....and are we glad she did!
While still in Alabama, Rebecca was always very responsive, informative and easy to contact. Being a family with young children, she was very helpful when we asked about local pre-schools, dance classes, doctors, veterinarians, etc. As a mom, I felt much more at ease in settling into a new city with our young children.
When we arrived in Wichita for a 3-day house hunt, Rebecca made sure that we not only found the perfect house, but she also gave us a great tour of the city pointing out the abundant fun, family-oriented things Wichita has to offer. After our successful trip, we went back to Alabama feeling much, much better about our future in a city new to us.

Your best answer will come from the lender that you decide to work with. This determination is primarily based on your credit score and your debt to income ratio. If you want to keep his house and use it as a rental your lender can help you with that information as well.
Also: while you are not on any of the paperwork for your husband's house you WILL have to sign off for him to sell it since you are married. In Kansas it takes "one to buy and two to sell". Individuals can purchase regardless of marital status. Married individuals must have their spouse consent to sell even if they are not on the deed or mortgage.

Yikes! You have quite a can or worms here. I am not an attorney but this is an interesting situation. You should absolutely speak to your agent's Broker immediately. I'm not sure how the title company managed to receive and process an incomplete contract that wasn't fully executed. The Broker may be able to help you straighten it out. If they cannot you may need the advice of an attorney. I generally counsel my buyer clients to limit their earnest money to amounts that can be retrieved via Small Claim Court. The last time I checked the limits for Small Claims Court were for amounts of $2500 or less so you could end up in regular court. I would be very surprised if you didn't prevail. Hopefully the Title Company will recognize the error and return your funds without any additional problems. Best of luck!
