Title companies in Texas will not accept a "Quit Claim" but instead will insist on a Special Warranty Deed at a minimum if title is to be insured. Google KB Home and look at all the results and ask yourself if this is something you want to buy into. I have encouraged all my buyers to shy away from KB purchases, whether new or resale. There is a reason for the ongoing litigation and ignoring it won't change that. In my opinion, KB subdivisions seem to decline rapidly and selling them a year ot five years later is often very difficult to do. - Wed May 21 2008, 22:22
If you used the promulgated contract form that agents in Texas typically use, you are likely in a unilateral contract. You have to sell but the buyer does not have to buy....at least not until any contingencies have been satisfied or waived, at which time it becomes a bilateral contract and both parties are obligated. Of course additional language may have been added to your particular contract which may have given you some way out, but not likely. Best advice you can get in a situation like this is to seek competent legal counsel before you attempt such an action. Note that some companies will offer to add your FSBO information to their site at no cost to you. Most especially companies from outside of your town or even outside of your state will offer to "help". Why? Because they will generally sell your information to one or more agents right back in the very city where you're located. It may be free to you but their only intent in the end is try and get one or more referral fees from agents in your area, and should you decide to list, you might very well end up with a very hungry agent, not necessarily and very good agent. - Wed May 21 2008, 21:53
