Hi JR - that would depend on the agreement worked out between the agent and the buyer.

The question then becomes one of "what is your time worth?"

Personally, if I were working on a flat-fee basis I would expect to be paid regardless of a sale. "Commissions" are based on sales...flat or hourly rates are based on time spent. If you choose not to pay me via commission, then you are choosing by default to either pay me a flat or hourly fee, or to not use my services. There is no such thing as a free lunch.

If a buyer is making use of my time, gas, effort, knowledge, and experience I deserve to get paid and provide for my family just like any other working professional.

But that's just me - all commissions and rates are negotiable and I'm sure that if dan looked around hard enough he'd find an agent who would work for peanuts. Not me, though. - Sun Jul 6 2008, 07:33
Just for reference - re comment by Dan about agents duties to the consumer...

I'm sure that if you asked, you could have a wonderful buyers agent working for you on a flat-fee basis - commission dollars wouldn't come into the equation at all (in fact, in Florida that's called an Exclusive Buyers Agreement...and it can be made with compensation based on either a percentage of the sale or with a flat fee to the agent).

It seems that you would much rather pay an up-front flat fee and know that the agent has no stakes in how much money you spend after-the-fact...that might be something for you to look into.

How did you find the place? Have you been inside yet? Who brought you inside? What contact have you already had with the listing agent? Have they done any work for you yet?

The reason I'm asking is that if the listing agent brought you through the house already, they could potentially sue the agent you allow to "parachute in" for the commission after-the-fact, with the argument that they were the procuring cause for the sale.

what can delay closing?

Generally if a closing is delayed beyond the "closing date" set forth in the contract, both sides would have to sign an addendum to the agreement stating that they both agree to extend the agreement for another X number of days. If the seller is unable to sell the property due to an IRS Lien and cannot close on time, all you should have to do is "NOT" sign the extension and tell your realtor that you no longer want the home.

I'm not an attorney, and I am also not familiar with the specific wordings of your contract, but based on the information you've given, that would be my advice.

Just to clarify...according to the NAR Code fo Ethics, if the customer (i.e. Lorena) initiated the contact with the 2nd agent, the 2nd agent absolutely can continue to help the customer even after finding out that the customer is already under contract.

As a REALTOR, you should not SOLICIT the business of another agent, but if the customer comes to YOU it's a completely different story and you can (and probably should) help the customer in whatever way possible.

The first thing you should do, and your best bet is to speak with the broker in charge of the agent you're currently working with.

Explain the situation to them and ask to be either 1) taken care of properly and to your satisfaction or 2) let out of your current buyer agency agreement.

If the broker declines to let you out of your Buyer Agency Agreement, your best bet will be to contact a local Real Estate Attorney for advise. Your situation is spelled out in your contract with the broker you're currently working with, but only a lawyer is qualified to interpret that contract for you. The couple hundred dollars you spend on the lawyer will be well worth it in the long-run - and will also serve to give you peace of mind that you are moving forward on the right path (invaluable when considering all the other stressors involved in purchasing a home!)

Based on what you wrote about your situation, it may very well get sticky - but the lawyer should clear everything up for you.

i am renting a house that is being forclosed, what do i do

Can you purchase the home?

start looking for another place to live just in case you need it (better safe than sorry)

Call your landlord and try to negotiate a HUGE rent reduction in exchange for you not moving out right away (evidently he's not paying the mortgage with it...and I guarantee he'd rather have a good tenant paying than an empty apartment he's trying to rent with no money coming in)

These are just my random "brainstorming" thoughts...take them with a grain of salt.
