It depends what the terms of the withdrawal were and what the listing agreement says. More than likely you should be fine. I know that most agents would not go after a seller for commission like this, especially if you terminated the listing. If the property was unlisted for 6 months you should be fine. Also, the agent is only protected if your family member contacted he or she as an interested party during the time of the listing. - Fri May 22 2009, 13:49

Hi Linda,

Just to chime in on some of the other comments, I think you would be remiss not to have a look at communities such as Lakeshore Village and Venetian Falls. These are both communities that I have had recent sales in and I think they would fit the bill for what you are looking for. The prices in some of these 55+ communities are unbelievable. They are often less than $100 per square foot. Best of luck in your search and if I can be of further service let me know.

Chad it depends on the specifics of the contract. If you used the FAR9, there is a loan commitment date involved. If you did not provide notice on or before that date of your inability to close, your deposit could be retained by the seller. Since you were "forced" to use a lender, I am guessing this is bank owned property. The bank addenda will likely be very complex. If you feel you have the rights to keep your deposit, this would be a case where you should seek legal help. What does your realtor have to say about the situation? Her/His brokerage should be able to offer you some insight. - Mon Dec 8 2008, 11:22

I concur with everyone here and think that you will have the best luck in Palmer Ranch. I am getting to take a beautiful listing of a nicely upgraded condominium in Plaza de Flores (not a condo conversion) that has 2 bedrooms and a nice view. Price should be in the mid to high $100s.
