Rosalyne, Chances are you are NOT dealing with the Homeowner at all but some shark who has put himself in between you and the Homeowner. They usually try and get a quit claim deed on the former owner's property, do a "subject to" of the original loan and payments (this is not allowed and will force further immediate action on the property against the homeowner should the lender discove the charade) and then try to get a sucker to come along and "think" they are getting a deal on a price as the alledged "new" owner sells for way below the recorded documented loans or worse yet does a "lease-option". They of course will need a "Option" payment plus first and last rental payments or the payments owed on the house, then they walk and leave you holding a worthless investment. These "Sharks" also do this to many folks on the SAME house!! Don't fall prey to these sharks. If you can't qualify for a home now, even with FHA, then you should NOT be buying but planning and saving for the future. These prices are going to be with us for a while to come so don't panic and make a dumb mistake! - Yesterday, 08:39

Tracy, I'm a bit confused by "DRE sanctioined"? The Department of Real Estate works with licensees and NOT attorneys unless the attorney seeks a license (which they can due to being an attorney). I don't understand the "court orders" either. The AG of California, Jerry Brown, just setted a huge lawsuit with BofA and Countrywide to rewrite "option ARM" programs to 90% of current value but it concerns just these loans and just Countrywide homeowners. So I suspect these guys are trying to cash in on a court decision by "showing" the consumer just how they can collect! Is this a Contingent Fee operation--you perform THEN get paid, or is it a fee up front with no gaurantee of a settlement? I'm also a bit disconcerted about the "Green Credit" name which is either a horrible parody or an attempt to cash in on the "Green" movement. Keep us posted as to your discoveries as I'm seeing more and more loan guys who are now touting themselves as "Loan Modification Specialists" and collecting fees for something the consumer can do themselves. - Mon Nov 10 2008, 09:07

Can you negotiate for the seller to pay for inspection?

Michael,
Asset Managers don't like to be nickel and dimed nor do they really like big negotiations after the contract has been accepted. Some even state in the contract they will NOT consider negotiations AFTER inspections. So as JR stated, "Highly Unlikely" your scenarios would happen. But here is a bigger caveat for you and all Trulians--Many of the "sales addendums" you sign when the offer is accepted have a "passive" form of contingency removal. This simply means if you have 10 days for inspection and the tenth day comes and goes and you have NOT responded back in writing to them you have "waived" your inspection and everything is deemed approved. Be very CAREFUL on this one as they may let you OUT of the deal but guess who's deposit will NOT be returned? YOURS! - Sun Nov 9 2008, 17:54
