Can a Seller Revoke Acceptance?

I agree with Scott's answer. The San Francisco offer contract specifically states that a seller cannot unilaterally cancel a contract unless a buyer fails to perform (and then, the seller still needs to provide an additional "24-hour notice to perform" notification). The big question is whether you were "in contract". If you accepted the seller's counter-offer as is, and delivered the signed paperwork back to the appropriate party within the timeframe specified on the form, and did so before the seller rescinded the counter-offer, I would think you were "in contract". If any of these steps or timeframes were missed, I would say you were not. Speak with your agent. If they confirm all the steps were handled correctly, you'll likely need to engage an attorney. - Sun Aug 3 2008, 10:46

Hi Mandy,

Typically real estate lawyers are not necessary in California real estate transactions (though I know my brothers need them back east). Your next step is to connect with a realtor that can help you get pre-approved with a lender (every seller will require a letter to show that you are able to purchase their home). Once you've completed that step, they'll work with you to write and submit your purchase offer. You didn't mention the price range that you're looking at or what you've saved for a down-payment. These are very important considerations, and there are a lot of options out there (regular financing, FHA, etc). Buying a home can be stressful, but it should also be fun and exciting! What's the best neighborhood in San Francisco?

Because San Francisco's neighborhoods are so diverse, this question is very difficult to definitively answer. What's "best" to one person may be "worst" to another. For instance, someone may choose to live "near the action" in a place like North Beach or Eureka Valley. But someone else may like a more "sleepy" area like Miraloma Park or West Portal. If you have multi-millions to spend, you may be interested in Sea Cliff, Pacific Heights, or St Francis Wood. With all that being said, San Francisco Magazine conducted a poll several years ago asking "If price weren't an issue, where would you like to live". The "winning" answer was Noe Valley due to its many amenities, weather, and family-friendly atmosphere. Hope that helps. :-) - Wed Jul 16 2008, 15:57

Is having a professional stager really worth the cost?

Hi Reg,

Unless your property is a fixer, in San Francisco it has become a necessity. Originally only houses in the multi-million dollar price range were staged. Today everything gets staged (a recent buyer client bought a one-bedroom condo in Diamond Heights, and it was beautifully staged). If you don't stage your property, your home will compare unfavorably to buyers out there, who've now come to expect "pretty". Remember, staging is not remodeling. It usually doesn't make sense to remodel a home for sale, but it almost always makes sense to stage it. - Mon Jun 16 2008, 13:21

As a Miraloma Park homeowner for over 14 years, I can attest that it is a great neighborhood to live in. As San Francisco Magazine called it a few years back, it's "The City without the gritty". It offers great proximity to all that SF has to offer, but the advantages of being slightly removed from it all (for example: no homeless people sleeping in your driveway!). As far as weather, it is definitely on the foggier side of the City (anything West of Twin Peaks will be foggier than East of Twin Peaks). However, depending on the specific property, you may be sheltered a little based on it's location. For instance, even when my front yard has howling wind, my back yard is nicely protected by Mt Davidson and the neighboring trees. As far as traffic, the busiest times on Teresita are when you'd expect: during commute hours. People will use Teresita to connect from/to Monterey Blvd from/to Portola Drive. There's also the #36 bus which travels along Teresita as well. Even so, during the night hours it gets pretty quiet. - Sun Jun 15 2008, 11:42
