Hi Yoyo,

In my experience with Short Sales, in our initial communication/negotiations with second lenders, over 80 percent of them always start with “we are not going to cooperate” or they want more money. It is amazing the large percentage that change their minds just prior to foreclosure and they realize that the fact that they are getting something now is better than a worthless sheet of paper a few days from now.

The listing agent should be able to write a compelling letter (with numbers crunched) to change their minds because if they (the 2nd) hold out and let the house foreclose, their note will get wiped out and they won't see a dime!

My advice is to hang in there because it is mostly up to the listing agent now to sway the 2nd.

Foreclosure Property Advice in SF

Hi Lawrence,

I just researched this home and it's currently active - contingent (in contract with contingencies not yet removed) with a listing price of $775,000. However, it has been in this status since 5/13/08. I don't know how or why it was posted on Realty Trac as a pre-foreclosure with a list price of $150,000. Most likely, the loan has been defaulted and NOD was recorded although there is no indication on the listing that this is a short sale or (pre-foreclosure). Here is a link to the listing...

To answer your question of what needs to take place, you will need to have your realtor contact the listing agent and see what the deal really is. If you don't have one, let me know and I can make a quick call for you.

Hi Benjamin. If you already have a realtor you're working with, they can easily look up an address and see who the owner (& vice versa) through their preferrred Title Company. Hi Gabe,

My office is right by Westwood Highlands and know the are very well (along with St. Francis Wood). Westwood Highlands or Westwood Park are both great alternates for St. Francis Wood if your budget is $1 mil. The fact is that these two neighborhoods have been high in demand and not a lot of homes come up for sale. Currently there are THREE homes for sale in these two neighborhoods, two of which are below $1 mil.

Based on the law of supply and demand, there is definitely upside potential appreciation with these neghborhoods in the next 5-10 years.
