Price, Condition, Location.

You can't change the location. Make sure the condition is good. Make sure the price is GREAT.

There are lots of homes selling right now in Metro Detroit. They have one thing in common: a good price (in the buyer's eyes).

I can't think of anything you can do to get that house at your price if the builder will not accept it. The only thing you might be able to do is ask the builder if he would carry a second mortgage for the difference, but the payment of the two loans would probably be more than you are comfortable with. - Fri Jul 18 2008, 14:45

If you accepted the offer in writing, then you are in a deal. Do you have any contingencies left? Inspection? Mortgage? Could those get you out of the deal legitimately?

I believe the agent is correct about your 2 options, but you should consult an attorney if you do not plan on proceeding. Also the bank could sue you for specific peformance, though I doubt they will do that. - Thu Jul 17 2008, 05:23

If you signed accepted the offer in writing then those are your choices. Close or forfeit. If you forfeit, the bank could sue you for specific performance, though I doubt a bank would actually go to that length.\

If a home is uninhabitable, many borrowers will have trouble getting a loan. A seller can sell under any non-discriminatory terms they want.

Bank Owned house with multiple offers.

Apparently the assistant did not know what the agent knew. The agent and the assistant are the only ones who might explain what happened.

Whatever happened though, it sounds like this house is not available anymore. You can tell them that you would like to leave in your offer as a back up. - Sun Jul 13 2008, 04:46
A home cannot be sold twice. If an offer has been accepted, they cannot accept another offer.

Dealing with banks is tough, especially when there are competing offers. You did not get screwed, and you do still have a chance if this buyer does not like the inspection results.

Does not sound like you have a buyer's agent. Bank deals are much harder to negotiate, and you don't pay the buyer's agent, so I strongly urge you to get one. You will not be given the commission (the listing agent will get it if you are unrepresented) so you would be better off to have someone helping you navigate the REO world. - Sat Jul 12 2008, 02:47
