You said that the buyer "delayed the closing". Can you be more specific? Did they ask you to sign a mortgage extension request? Or did they just not do anything and let the deadline lapse? Was it the lender? Either way, this is a question that needs to be asked to a lawyer.

If we're talking about deposit money keep the following in mind for future reference... In CT, there are only three ways to get your money out of escrow. Mutual agreement, a closing, or a court order.
