You will need to review the policy for the details and exceptions etc. However you should keep this in mind, oil tanks generally are test on the four sides for leakeage, not below the tank.

With that being said it is best to get the tank removed and put above ground and the state has a grant available that covers the cost for this (generally) and then you can ensure there is no leakage below.

Your answer is when you said 'bid'. Since it was not an accepted offer that was put into a bind agreement then the bank truly can do as they wish, similar to that when an owner gets a 'bid' but doesn't accept it.

Unfortunately the logic that you have isn't what the bank has and like other agents have contributed the bank sometimes do things that don't make sense, but it is there property.

two questions about using agent

This is a great answer. You can absolutely choose another agent to represent you in the purchase. If you give me a call I will be happy to do that.

Unfortunately if you are not comfortable with disclosed dual agency then you will not be able to buy any property listed by a brokerage firm (as agency refers to brokerage firm not just the individual agent)

For example if I as a RE/MAX Village Square agent list a property and a colleague of mine in one of our RE/MAX Village Square offices wants to bring the buyer it is still disclosed dual agency, however if any other firm including another RE/MAX brand (ie RE/MAX Professionals) brings a buyer it is not dual agency.
