Sorry to hear about your frusteration, Even agents are frusterated by the banks making all the rules and trying to force everyone to adhere to them. As far as filing a complaint check with an attorney, bottom line there is no contract between either of you.
In all honesty I hope you are looking at other houses while you sit and wait on that offer. As a buyers agent I would never advise my client to just sit and wait while someone who doesnt really want to sell a house tries to well, sell a house.
Bottom line, they can only sell it to one person so I would not hold your breath. Regarding over bidding an asking price, i have written offers up to 30,000 over asking price on a house listed under 100,000 and still did not end up with the house.
