"I first met Sylvia Barry when I interviewed her for a Project Manager position at the Insurance Company I worked for. We worked together for several years afterwards until we went separate ways. When I decided to sell my house and move to Arizona, Sylvia told me that she had become a Realtor and would love to represent me. She brought the same skills I had admired when she was a project manager to the job of real estate sale person. Thoroughness, attention to detail and follow through, making sure everyone did their jobs correctly and on time. There is an incredible amount of contractual requirements and paper work involved in selling a house. She made sure all the forms were prepared correctly and signed by all the necessary people. Thanks. You know what, I slipped in my answer below ... ......... not that it mattters because, again, I am CA.

Even in CA, we are the same, we are required to present ALL Offers to the seller. However ,most of people don't make an offer if the house is in escrow already unless they want to be in back up position.

So, my next question is, what do NewYorkers do when there are more offers coming in after the house is in escrow? Just my own curiosity.

Hi Victoria:

From what I read, the owner has already accepted an offer from the first buyer, so the house is already under contract with the first buyer.

However, you are very interested in this house so you also want to present an offer You agent told you since there is an accepted offer, your offer will only be accepted if the first offer fall through. Correct? .

Unless N.Y is vastly different from CA - Your agent is correct (O.K. Correct me NY agents, I know there are differences between the two states) in that is the house is under contract, yours won't be in contract unless the first one falls through.

However, that does not present you from making a back up offer if the seller would accept that. You should definitely ask your agent to do that. If the first offer falls through, you will be right there. I would think it's in the seller's advantage to have a backup offer.

As far as Dual Agency is concerned - In your case, since your agent, although belongs to the same brokerage as the listing agent, she is not the listing agent. Technically, it's dual agency in the sense that the contracts are really through the brokerage instead of individual agents.

However, it's not the same as having the same agent represent both sellers and buyers. Your agent will represent you and the listing agent will represent the seller.

This happens quite often with big agencies - century 21, Caldwell banker, re/max, Keller Williams, etc. My company has 400+ agents in S.F. North bay, and has the majority of the market. We would be eliminating representing 1/2 of the buyers if we can't represent buyers to buy listings by our agents.

Hi Matt:

Did your contract include a Short Sale Addendum? This is what truly protect you from the event like this. For my clients who are making offers on Short Sales, they will sign the Short Sale Addendum which specifically say (depending on which option you pick) that the time does not start, the escrow does not open, the deposit will not go anywhere, the inspecition will not be performed UNTIL after we received a written approval from the lenders.

I never ask my clients to conduct inspections until there is a lender's written approval.

Without this addendum, you might be at risk.

You want to check with your realtor, the realtor's broker and a realt estate attorney if you don't have that.

I think courtesy is the most important thing when you approach FSBO.

Have to bear in mind that when people do FSBO, some do not like Realtors at all, others just want to save commission, thinking they can. They have to try it out and prove or disprove their own theory.

So, give them some room, be polite, be helpful and don't tell them they won't be able to sell without you - I really think they resist that notion, otherwise, they would not be going FSBO first - follow up with them in a none threatening way, then wait for them to call you.

Broker rates what percent?

You need to get the buyers into your home first and have them look at the home in the most positive light.

All things equal, other than price the house very competitively, you want to hire an agent who is great at marking your house for you - an agent who has a good eye for decorating, how to best present your home, Internet savvy, great network, knows where to market your home to get the most exposure,, work for a reputable company, etc.

Find a great agent with reasonable commission, instead of great commission but a mediocre agent.

Hi Mills:

In this day and age, there is really no excuse not calling you back within a day - at least to let you know when you might expect to talk to him if he is tied up in meetings or out of town.

Although the agent is referred by a friend, you are not obligated to use him unless you are happy with his performance, especially with such a big transaction in your life (whether it's a big transaction for him is irrelevant, this IS VERY IMPORTANT TO YOU!). I personally think you have given him enough time.

There are many very good S.F. agents on Trulia. Look for ones who answered S.F. questions and read their answers and check their profile to see if you like them. Interview them to find the best one for you. If you can't find any, I will be very happy to refer an agent to you.
