"We met Sylvia Barry during our first open house when we tried to sell our property in Novato by ourselves. Many realtors came out to meet us, but Sylvia stood out in the crowd. "I first met Sylvia Barry when I interviewed her for a Project Manager position at the Insurance Company I worked for. We worked together for several years afterwards until we went separate ways. When I decided to sell my house and move to Arizona, Sylvia told me that she had become a Realtor and would love to represent me. She brought the same skills I had admired when she was a project manager to the job of real estate sale person. Thoroughness, attention to detail and follow through, making sure everyone did their jobs correctly and on time. There is an incredible amount of contractual requirements and paper work involved in selling a house. She made sure all the forms were prepared correctly and signed by all the necessary people. She also added the heretofore unknown to me skills of a home decorator, making suggestions as to how we could make our home more attractive to prospective buyers. All in all, the home selling process was made much less stressful by Sylvias skill and competence. When we got eight offers, seven over asking price, she suggested we take the best two, and ask one of them to be a backup offer. Extra cash for agent incentive??

Hi Steve:

The best way to sell a house fast is to prepare them for sale (update, repair, stage), price them competitively, do the best marketing (Internet marketing is quite important now a days) to get the most exposure you can for your house, providing agent incentive does not work magic.

I provide my clients with information on houses they will like and they will either let me know which ones they like to see.

I do not include or exclude a house just because of my own commission or incentive because the goal is to help them find the house they will like otherwise we will be wasting time and energy on both ends. We also want to build long term relationship with our clients where they know we watch out for their best interest, not ours.

Imagine what they will think after they bought a house and found out there are more superior (or comparable) houses that meet their criteria out there at the same time when they are looking and we did not bother to show them the house? I would not want to be the one who's in that position.

That extra money might be better used for things on the house, or as others said, incentive back to the buyers.

If they don't know the rule, then you might just want to leave them a note and let them know that they are not suppose to do that for neighborhood safety reasons. This is usually what I will do - to give people the chance to correct mistakes they make.

However, it they do this consistently (which I assume they are) and/or they would not change their ways after you have advised them, you should be able to report them to the police - you can do that anonymously. This is a safety issue and should be taken seriously.

If you are willing to spend the time and effort to do it, then go ahead and make the offer, becauses if you don't make the offer, then it's an automatic loss.

However, I do agree with Michael, some of the agents are pricing houses Way, Way, Way below a reasonable price, and I suspect, trying to either get multiple offer and drive up the prices (which I have seen in Novato, Marin County) or just to get an offer in and go through the process of getting approved by the bank and delay the foreclosure.

Ask the listing agent if the bank has given them a net proceed they need to receive ini order to proceed when they were negotiating with the last five offers. That will give you a better indication on how much the bank will actually accept. However, if you are going for short sale, especially with the one that's priced low, be mentally prepared that there might not be much negotiation room on repairs and credits after you are in escrow (after the lender accepted your offer).

My apology, now that Greg poinited it out, I noticed that she represents both sides. I agree with Greg, this is called Dual Agency and most of us do not do that due to conflict of interest - where your concerns might come from.

Since this is after the fact where you have already sigend on with her to use her as your agent, she is already representing you. However, your purchase contract is really with the Broker of the agency rather than than agent (your agent), I still think you need to talk to her about your concerns. However, if you still do not feel comfortable, go to her broker and have the broker assign another agent to work with you before you switch to another broker.

Although I don't do it and I don't believe in it, there are times when dual agency works, but certainly not in your case.

Talk to you agent and tell her about your concerns. If you have specific questions, make sure you address them to her, and if she is not giving you the kind of answers you are looking for, you might have to rephrase your question. If you are still not getting anywhere with her, you might want to talk to her manager so you can get the kind of service you are looking for.

Buying a house is probably the biggest purchase you will make and it is very important that you understand everything and that you are comfortable with what you are doing.
