Eli, I am so sorry for you having to go through this rough experience. As a landlord, we have had a few renters not pay and really mess our home up...It is so difficult. I would ask your realtor for a copy of the 3 day notice he/she delivered- document the dates. It has been easier for us to actually pay renters to leave than hire a lawyer and wade through the eviction process. You might discuss this with your realtor. Have him approach the renter and say that eviction process will begin on such a day...offer them say, $500 cash if they will leave the home in good condition in 1 week. Or some such arrangement.
I think it is a good idea to speak with the agent's broker- I know my broker would be all over me if I brokered a rental agreement and gave the renters a key without their paying at least first months full rent and a deposit. The broker may get more results than you are being able to get with the agent.
You asked if you could get a new realtor. When you listed, you signed an agreement for a certain length of time. Different agencies have different policies. Our office policy is if a seller is unhappy, they will always be released from a listing. Again, this would be a good issue to discuss with the broker.
I think I would try to communicate with your agent a bit more and ask them to see this thing through that they started.
I wonder if the renter has any connection with the agent???hmmm.
