About Me
South Whidbey is My Community
My husband Lance and I moved to Langley in 1983 from Seattle with our two young children, because we thought Whidbey Island would be a good place to raise our family. We soon learned it is a GREAT place to raise a family. I spent the next 20 years doing that, along with helping hundreds of others parents by teaching classes, attending births as a doula, training doulas at the Seattle Midwifery School, directing a non-profit aiding parents, and volunteering with numerous community concerns.

I Love Real Estate
In the mean time, I designed and we built two homes on the island, a log home and a straw bale house. We remodeled another house into a duplex and renovated 3 fixer-uppers. We sold one, and turned 2 into rentals. We are currently carefully developing a new piece of raw land. In the process, I discovered that I love real estate- walking boundary lines and considering building sites, planning new construction and doing renovations, thinking about investments and cash flows, and mostly imagining turning a house into a home for someone.

Eli, I am so sorry for you having to go through this rough experience. As a landlord, we have had a few renters not pay and really mess our home up...It is so difficult. I would ask your realtor for a copy of the 3 day notice he/she delivered- document the dates. It has been easier for us to actually pay renters to leave than hire a lawyer and wade through the eviction process. You might discuss this with your realtor. Have him approach the renter and say that eviction process will begin on such a day...offer them say, $500 cash if they will leave the home in good condition in 1 week. Or some such arrangement.
I think it is a good idea to speak with the agent's broker- I know my broker would be all over me if I brokered a rental agreement and gave the renters a key without their paying at least first months full rent and a deposit. The broker may get more results than you are being able to get with the agent.
You asked if you could get a new realtor. When you listed, you signed an agreement for a certain length of time. Different agencies have different policies. Our office policy is if a seller is unhappy, they will always be released from a listing. Again, this would be a good issue to discuss with the broker.
I think I would try to communicate with your agent a bit more and ask them to see this thing through that they started.
I wonder if the renter has any connection with the agent???hmmm.

IN WA state, agents can check the "property history" for you to see if the home has gone STI (subject to Inspection) and then fallen back to Active (back on the market for sale). This is a bit of a pink flag, but just know that the home could have been fine but the buyer may have just got cold feet, could not get financing, asked for unreasonable repairs from the seller, etc. if a home goes back to active a few times- be careful. get a good inspection and know that you may have an anxious seller and you may have a bit more room to negotiate. If health and safety repairs are needed, and the seller can't or won't do them for you, you can sometimes ask for the seller to pay for "allowable closing costs and prepaids" often up to 3% in lieu of repairs so you have more cash left in your pocket at closing to handle the repairs yourself. A lender has advised me not to write on the contract, "in lieu of repairs, seller will pay >>>" because you don't want to worry the underwriters about what kind of repairs are needed. I am on Whidbey Island, WA so things may be a bit different here. I have heard of a few people being able to improve their soil test by adding french drains around the perimeter of the property to help drain the soils in the center and get more permeability. Ask realtors near you who work with land who the best septic guys are in your area. See if any of them have ever remedied the problem you have encountered. Be careful not to throw good money after bad if there is little hope. If no-one has a plan now, I have every confidence that septic system technology will continue to evolve and maybe in 10 years more solutions will be available. Sorry for this challenge, it really some of the worst news you can hear about a property. Everyone else, Use a reputable agent and don't be buying property without a site registration assuring you of adequate soils for a septic system unless sewer is available to you. I often have people ask me..."Well what if I get a composting toilet/" but the issue is getting rid of your waste water and letting it percolate through the living soil to "cleanse" by the bilogical adtion of the flora and Fauna that live in the soil that will "eat" the bacteria etc, so the water returns to the water table pure- let's all sing the Lion Kings"Cycle of Life" La La La. . I feel for you! I am a realtor and was just representing a buyer with a home that happened to; It seems that the bank did not hear that I had a willing buyer with a signed purchase and sale agreement ready to purchase the property at the end of the month for $225k. The bank sold it on the court steps for $83k. So the homeowner lost all her equity, plus the lien holders lost out, my buyer, the other agent and me- Only WA Mu got what they were owed (it was not a short sale.)

What I learned was to next time keep inquiring about the process, how far into the foreclosure is the property, is there an auction scheduled??? When adn Where? I would make sure the bank has been notified that a sale is pending. I will ask for a receipt of notice to the bank. I spoke with the woman's guardian a few times who had helped her accept our offer, but never spoke to anyone at the bank or the court. I trusted the Seller's agent to handle all that and that may have been where things broke down.
Anyway, The day after the new owner bought it at auction, he contacted me to sell it to my client, who by the way, had gotten cold feet in the mean time. So at present I am trying to purchase the home directly from the new owner. There is a lot more I have to learn about this process, and it appears we all may have ample opportunity in the near future. Good luck house hunting Daniel.
